Since he has no criminal record, once he completes the intervention program in January, his record will be wiped clean. Many first-time offenders get a chance with this. Cleveland Municipal Court (and Judge Stokes, the judge hearing this case) are big on this program. I've gotten it for my clients several times. So, basically, it becomes no blood, no foul for Whitner. He just needs to complete the program successfully.
