An individual mandate would have two features that, in combination, would make it unique. First, it would impose a duty on individuals as members of society. Second, it would require people to purchase a specific service that would be heavily regulated by the federal government.” But Pelosi, when asked about mandating health insurance, said "I believe that there is a provision in the Constitution that does give Congress this power, does she believe the Constitution in any way limits the goods and services Congress can force an individual to purchase?" She said Americans have a right to health care and Congress has broad power to regulate activities that have an effect on interstate commerce. Congress has used this authority to regulate many aspects of American life, from labor relations to education to health care to agricultural production.” ....“On the shared responsibility requirement in the House health insurance reform bill, which operates like auto insurance in most states, individuals must either purchase coverage (and non-exempt employers must purchase coverage for their workers)—or pay a modest penalty for not doing so. The bill uses the tax code to provide a strong incentive for Americans to have insurance coverage and not pass their emergency health costs onto other Americans—but it allows them a way to pay their way out of that obligation. There is no constitutional problem with these provisions.” Okay, the argument for the alleged right to health care is reduced to absurdity if it coexist with the right to bare arms....Americans don't think the right to bear arms requires the government to arm people with guns by (a) forcing gun shop owners to give guns away, (b) forcing gun shop owners to sell guns at prices and on terms dictated by the government, or forcing some people to pay taxes to fund the purchase of guns for others. People have the right to buy firearms from a gun dealer, and people have the right to buy medical care from a doctor, but people do not have the right to firearms or medical care. That ruling cracked the dike and the federal government has been steamrolling the private sector ever since with an ever increasing grab for power. The thirteen states never would have created - yet alone joined a federal government that viewed them as fiefdoms. The federal government received specific enumerated powers from the states and the states kept to themselves those powers not strictly enumerated in the Constitution. That's a far cry from the way the relationship is commonly viewed today wherein the federal government seeks to make crucial decisions for the entire country regarding what every private citizen, corporation and business can and can't do, have, use, eat, control, buy, earn, enjoy. We've lost a lot of our freedoms already in this continuing stealthy power grab by the progressives and statists. There's no end in sight to this relentless march toward socialism - which many of the "best minds" that FDR brought with him to Washington so admired and sought to bring to bear in America.
