It's probably going to boil down to whether-or-not he consented for NBC (the ones who took the initial footage) to do whatever they wanted with the video they shot. If NBC retains the rights to the footage and subsequent use thereof, then he's probably got no case.

Definitely a far bigger sleazeball than Rove. Rove, at least, is in the sleazeball business (running campaigns and such in the diritier/hardball side of politics) and excels at it. Moore is not in the sleazeball business but chooses to be a sleazeball.
