It isn't a relevant question at all. The only relevant questions are about the evidence. Whoever investigates this crime is not going to investigate why the women waited, they are going to investigate evidence from that time. If there is a record of the women meeting with Columbia administrators and getting shunned, that will be taken into account. If the women told friends about the crime back when they happened and those friends come forward, that will be taken into account. If none of those pieces of evidence exist, that will be taken into account in Wiley's favor. The only question that won't be taken into account is the one you're exclusively focused on.

I’m not a lawyer but what investigation? This isn’t a criminal suit. It’s a civil trial. If so you’ll just have attorneys deposing witnesses.

Without an investigation, how do you even know who to depose? Of course they have to do some digging, and after all this time it’s going to be tough to pin things down.

A civil suit doesn’t involve the police. You’ll just have attorneys for each side asking questions (deposing) proposed witnesses from the opposing side. Those witnesses have to be listed and they may include expert witnesses who’ll testify to things like why people wait so long, etc.

I know it’s not a criminal matter. The attorneys will have investigators who dig for the facts. It doesn’t have to be the police to have an investigation, but there will be an investigation. You need as much information as possible just to know who to depose. That was the point I was trying to make.

My experience with civil cases is that there’s very little ‘investigation’. It’s mostly just stacking up expert witnesses.

One of my clients/friends was a defense attorney and his investigator was his right hand man. Willie would have been screwed if he didn’t have the guy who got answers to all the questions they had. Information is critical. That goes for criminal or civil. You still go 100% all out to win. It’s not like you give less than full effort because it’s not in criminal court. There is a LOT as stake here. 

 

I’m sure your experience was probably related to your field of work. Willie got involved with dirty stuff too.

True. My point is that there isn’t an independent investigation by the police or the court. Each side will conduct ‘research’ , more than ‘investigate’, to see what they can discover. …Which is why it’s called discovery, and not investigation.

I’m not going to go round and round, but discovery is what you have to share from what you have learned in the investigative process. Two different things.

I doubt many experts would be deposed for this case.  In New York it's not always routine.  An expert who would testify that it's not unusual for victims of sexual assault may not wish to come forward is something a plaintiff's lawyer can bring out in court and the defendants lawyer can cross.  

 

Such a witness isn't going to lead either side to settlement no matter what they put forward as their expert opinion.

I wasn't sure if I wanted to add to this thread, but since it's still going on, I think I will.

First, despite a few bro's with their typical mouth breathing comments  I appreciate the compassion and empathy of many who have posted.

In the 1980's my first job out of college was working in a residential treatment center for youth, before I ended up going into teaching and school administration.

One of the boys in the facility was 12, great kid to work with, but was extremely guarded. He had an issue with soiling his underwear constantly and thus had to be monitored by male and female because it was so prevalent. Can you imagine at that age how shameful and embarrassing this would be? The kids lived in cottages so all the other boys ended up knowing this was happening. He handled it, like it wasn't really happening to him.

Of course soiling can be be a sign of sexual abuse, but despite efforts by social workers and counselors on staff, while he was in placement he never so much as opened the door even ever so slightly that any abuse had happened. Well that was the 1980's, he left to return home to the Southern Tier in a small town after a few years. The facility didn't keep in contact with the kids once they left, so their was no update on his progress 

Well, a few years ago I got a friend request on Facebook from him and he casually updated me on his life. It was good to hear from him and I was pleased that he said he was happily married, has 2 kids and was working a decent job.

The messages took a turn when he broke away from his family, was distraught and was aimlessly heading out West in his truck.

He ended up sharing what had happened to him when he was a boy at the hands of one of his mother's boyfriends. He shared this by message as I think it was easier for him.

He was raped repeatedly for many years by this monster. He was bound, tortured cruelly and humiliated. 

He had buried this trauma for so many years, like so many do and releasing it let loose with a volcano of emotions that caused him to run from the decent life he was built, because he felt so ashamed, like he was damaged goods. He didn't know whether he wanted to live or die.

One thing he shared is that his mother's boyfriend often would force him to give him oral sex and would ***** in his mouth. This often caused him to gag. The man would tell him to go clean up and brush his teeth some of the time. He did.

Unfortunately, this association  between the forced oral sex and brushing his teeth gave him a gag reflex. Thus, this boy and eventually man would gag every morning when he brushed his teeth and of course the memories would end up coming to him of the cruelty he experienced. This has been going on every morning for over 30 years 

What is the price of the humiliation this boy faced? Would he be considered a gold digger if he brought a lawsuit against this man?

The shame and absolute hatred for himself has kept him from seeking justice and holding this man accountable.

Well, after communicating with me over a few months as he broke from his world, he ended up blocking me on Facebook. I think sharing was overwhelming for him.

I have no idea what has become of him. 

I wish we could have been able to break through and help him when he was a boy, it's heartbreaking when many wanted to help, but his mind and body buried the trauma and pain just so he could try to survive in this world.

It's been around 35 years since he was raped and sexually tortured, if he is able and wants to seek some form of justice, is he justified.

I hope he finds peace in whatever route he chooses.

What a sad, horrific story. Sadly, I have seen people who had similar experiences. I hope that somehow the person that you speak of will be OK.
