Now they're seeking Justice Sam Alito's recusal for his wife's personal political views. So why hasn't the Biden Justice Department motioned the Supreme Court for either justice to recuse in Fischer v. United States (No. 23-5572), United States v. Trump (No. 23-624), or Trump v. United States (No. 23-939). Maybe because Elizabeth Prelogar (Biden Solicitor General) and Michael Dreeben (counselor to Biden Special Counsel Jack Smith) know such a motion is legally frivolous? 3

To those calling for Justice Alito's (and Justice Thomas') recusal on January 6th cases because their wives expressed personal political opinions (3 years ago): Meet the-late Ramona Ripston. For 38 years, she led the ACLU of Southern California. She was the wife of the-late Judge Stephen Reinhardt on the Ninth Circuit. Ramona Ripston filed an amicus brief in the trial court in a same-sex marriage case. Judge Reinhardt--her husband--heard the appeal. He faced calls for his recusal. The left expressed indignation in this 2013 court filing: We are long past the day when a wife’s opinions are assumed to be the same as her husband’s, and in which spousal views and activity are categorically imputed to one’s spouse. No authority requires a judge to recuse based alone on the opinions of his or her spouse; only an “outmoded conception of the relationship between spouses” would hold otherwise. She's the wife of Judge David Barron, an Obama appointee to the Boston-based U.S. Court of Appeals for the First Circuit. (David Barron advised Obama he could kill 2 Americans with drone strokes, without any judicial process.) Juliette Kayyem always has lots of (leftwing) opinions. Lots. Just today, she opined about gun control. And Trump's pending, unprecedented criminal trial. Does this mean Judge Barron must recuse from all gun and Trump cases? Or only conservative judges must recuse when their wives express (conservative) opinions (3 years ago)?
