I'll address this in the other thread.  But suffice it to say that even if it's his opinion he's senile, that was the most devastating part of the report.  It might have been better to admit Joke should be brought up on charges and not talk about his senility.

Special Counsel Jack Smith's efforts to imprison Donald Trump for mishandling classified documents have hit a few snags recently, and the latest snag is, indeed, a big one.

 

"Special Counsel Jack Smith could be blocked from using evidence against Donald Trump contained in grand jury investigation files, which were transferred to the former president's Florida classified documents case this week, a former prosecutor has suggested," reports Newsweek. "In 2023, a grand jury in Washington, D.C., heard evidence from witnesses—including Trump's attorney, Evan Corcoran—while considering whether charges should be brought against the former president and others for hoarding classified documents. However, Trump and his co-accused were later indicted in Florida and, under federal rules, the grand jury files were transferred on Monday to Trump-appointed judge, Aileen Cannon's court."

 

According to former prosecutor Bill Shipley, the transfer of the case from D.C. to Florida gives Judge Cannon control over what evidence can be included—especially testimony that may have violated attorney-client privilege.

To clear up any confusion as to what Special Counsel Jack Smith sought to conceal in classified documents case, this is what Smith told Judge Cannon in Feb 2024 in response to Trump's motion to compel discovery from numerous govt agencies:

1) Defendants are not entitled to discovery of internal government correspondence and memoranda, or to documents that are otherwise privileged.

2) The Court Should Deny Defendants’ Requests for Evidence of 'Improper Coordination with NARA' and of 'Bias and Investigative Misconduct.'

3) The Court Should Deny Defendants’ Requests for Evidence Related to Trump’s Security Clearance With The Department of Energy.

4) The Court Should Deny Defendants’ Requests for Evidence Related to Secure Facilities at President Trump’s Residences.

5) The Court Should Deny Defendants’ Requests for Production of Materials Concerning the Search of Mar-a-Lago.

AND FINALLY:

6) Defendants’ Request for Unredacted Discovery of Materials Should Be Denied

"Special counsel Jack Smith’s team acknowledged Friday that some evidence in the prosecution of former President Donald Trump for hoarding classified documents at his Florida home..." may not be in the same sequence FBI agents found it when they swept into the Mar-a-Lago compound with a search warrant in August 2022.

 

The concession from prosecutors in a court filing Friday afternoon came after attorneys for one of Trump’s co-defendants asked for a delay in the case because the defense lawyers were having trouble determining precisely where particular documents had come from in the 33 boxes the FBI seized almost two years ago.

 

In their filing, prosecutors acknowledged the government had previously — and incorrectly — told U.S. District Judge Aileen Cannon that the boxes remained 'in their original, intact form as seized'....

 

In a post on his Trump Social site Friday, Trump [said]... Smith 'and his team committed blatant Evidence Tampering by mishandling the very Boxes they used as a pretext to bring this Fake Case'...."
