A few years ago a the husband of a coworker walked into the school we both worked at, and started screaming for her. 
 

When she came out into the hallway he immediately grabbed her and tried to force her to come with him. When she refused, he began to choke her out, in public. Two custodians (who happened to also be football coaches) and I forcibly removed him from the premises. He luckily didn’t fight back much, I think he realized that the odds weren’t with him.

 

She refused to cooperate with the school resource officer who showed up soon after, even though it was blatantly public.

What do you think he can say from his side that will make things more favorable? Unless the reported details have been fabricated, I think he's screwed. The police were there immediately after the incident and collected evidence.

His only chance is the girlfriend refusing to cooperate and using his high priced lawyers and influence to get some sort of plea bargain.


Guilty til proven innocent. Got it. 
 

All police reports are always 100% accurate, even when only 1 side of the story was told. Makes sense. 

 

And clearly we all know their relationship and what it consisted of.

All depends on how it's written. But if he gets suspended that's one thing that the CBA covers. Other written stuff can be included. I've already read where they could get out of his guaranteed salary next year but the prorated bonus amounts can be different because they cover more than one year. Lots of variables right now and too early to really know.

I'm not saying Miller did what is alleged.  Clearly the police and prosecutors believe there is evidence, since he's been charged and has turned himself in. Clearly sometimes the police and prosecutors are wrong and if they aren't, it's difficult to prosecute a crime if the victim won't cooperate.  So whether a prosecution will result is still unknown.

 

I probably shouldn't go here, but assuming the actions took place as alleged, exactly what reasons or "side" do you believe might justify putting your hands around the neck of/strangling your pregnant partner?

Technically, if there is solid evidence (like witness testimony from you and the two custodians), the prosecutor can file charges without the victim's cooperation. 

How often they do, can't say.

One point I alluded to earlier is that the NFL's DV policy requires that the league conduct their own investigation, and the player be suspended if they believe DV occurred even if there isn't a criminal case.    Greg Hardy (Carolina DE) jury trial for his DV case fell apart and was dismissed when the victim disappeared (allegedly after receiving a large settlement from Hardy).

 

The NFL investigated and suspended him for 10 games anyway (appealed and reduced to 4)

Tyrel Dodson DV charge was dropped to misdemeanor disorderly conduct/disruptive behavior - he entered a diversion program and had the charges expunged, but the league investigation suspended him 6 games anyway.

You know you're right. I didn't count that year cuz it was total purge and reload year and I didn't realize Josh started/played in that many games.  I remember going to two games that year. The Bears when Nasty Nate started and the Cheats when Derek Anderson started.  Then there was also the legendary Barkley start vs the Jets.  That was an ugly but necessary season that catapulted us into 4 straight playoff seasons, hopefully 5 or more.

Well obviously the two of them have talked since the incident and this is what she’s saying now, but the police are required to file a report once responding to a call and seeing evidence (her bruises, etc.) of a possible crime. So she didn’t file anything, the cops did.

True.  She called the police so her comments don't exactly align.  Who knows what happened between now and when she made those comments.

I hear you.  I worked as a defense attorney for years.  
 

unless she completely lied about the WHOLE thing though, he’s cooked.  And rightfully so.  The report is disturbing. 
 

More times than not, where there is smoke there is definitely fire. 
 

At this point I hope this clears a massive amount of cap.

She probably figured/found out how much money it would cost her and her children if he went to jail and never played football again.
