They don't need to agree to it nor do they have to be present in court. FYI, according to Touhey, Oher's mother was, in fact, in court. In one of the articles cited in this thread, Sexton was identified as a close family friend of Touhey as well as the lawyer who set up the conservatorship. His status and reputation doesn't exempt his actions from scrutiny in regards to the ethics of his being involved in giving his friend financial control of someone who became his client. Quote

Turns out that Oher wrote in his book (from 2011!) that he knew about the conservatorship. The NCAA would not have accepted Oher's "adoption" at age 18 in any case. What I don't understand is why the conservatorship would extend past his time as a collegiate athlete. It doesn't sound like Oher's lawyer has done his homework on the income streams stemming from the "Blind Side". He is assuming the Tuohy's wealth came from the story and film as opposed to their franchise businesses. He wants a "full accounting" of what they earned from the "Blind Side" which is an admission that he has no clue. His lawyer sounds like a race based shakedown artist. And if Oher is dumb enough to follow his advice, he will be publicly shamed and outed as a fool.
