If the other substantive weaknesses in the politically constructed Manhattan case against Donald Trump do not lead to a pre-trial dismissal, this one should collapse it.

 

The Commissioner of the Federal Election Commission (FEC) explicitly states the payments by President Trump to Stormy Daniels are not an election campaign violation.

 

WASHINGTON DC – A key member of the Federal Election Commission today rejected the Manhattan district attorney’s indictment of former President Donald Trump as a violation of federal election laws.

 

“It’s not a campaign finance violation. It’s not a reporting violation of any kind,” said FEC Commissioner James E. “Trey” Trainor.  In trying to stretch the law to make it look like a violation, he added, District Attorney Alvin Bragg “is really trying to make a square peg fit into a round hole.”

 

In a 34-count indictment of Trump, the first criminal case ever against a former president, Bragg charged that a $130,000 payment made by former Trump lawyer Michael Cohen to porn star Stormy Daniels, which Cohen went to jail for in a plea deal, violated several campaign finance laws that splashed onto Trump. [T]he FEC and Justice Department already considered the case and tossed it.

 

First, he said, Cohen took the blame in his plea deal. “At the end of the day, there’s the person who committed the crime, and there’s the person who is behind bars because of it,” Trainor said of Cohen.

 

Second, the paperwork violation in question came well after Trump’s 2016 election, so it couldn’t have been done to help his election.

 

Third, it is not obvious that the reason for the payment and the reimbursement to Cohen was to influence the election, thus failing the “objective standard” of law. “It has to be something that anybody on the street can look at and say the only reason you did that was to influence the campaign,” said Trainor. “There’s a lot of reasons that he could have done it that aren’t related to him being a candidate for president, and so therefore, it wouldn’t have met the standard as campaign expenditure under federal law,” he added.

Manhattan District Attorney Alvin Bragg’s urgent request to enter a restraining order against Rep. Jim Jordan (R-Ohio) was rejected on April 11, the same day it was filed.

Judge Delivers Bragg a Serious Smackdown in Denying His Order

Last week, Manhattan DA Alvin Bragg brought a 50-page complaint against the House Judiciary Committee, its Chair, Rep. Jim Jordan, and Mark Pomerantz, one of the former assistant district attorneys in his office. He also filed a motion seeking to enjoin the House and Jordan from enforcing a subpoena against Pomerantz and enjoining Pomerantz from complying with it.

 

Sure sounds like Bragg is desperate not to have them speak with Pomerantz, who can offer them a lot of insight into the evolution and possibly the political nature of the effort against former President Donald Trump.

 

As I reported last week, the judge in the matter. U.S. District Court Judge Mary Kay Vyskocil, declined Bragg’s request. As I observed at the time, the judge noted that Bragg didn’t even provide documents he should have to support his cause, including that “subpoena purportedly served on Mr. Pomerantz” as well as the “Declaration of Theodore J. Boutrous, Jr.,” which is mentioned in Bragg’s moving papers.

 

But if the judge chided him last week, noting the things that he didn’t file, she truly gave him a smackdown in the order that she entered on Wednesday. I’ve included some fun comments from Prof. Margot Cleveland.

House Judiciary Committee Gets Green Light to Depose Former New York Prosecutor in Trump Case

 

 

It appears the public will be learning more details regarding New York’s decision to indict former President Donald Trump over the Stormy Daniels matter. Despite Manhattan District Attorney Alvin Bragg’s previous efforts to stop House Republicans from speaking with his predecessor, former prosecutor Mark Pomerantz, it appears he is reading the room on this issue and has struck an agreement with Rep. Jim Jordan (R-OH).

 

 

ABC News reported that Manhattan District Attorney Alvin Bragg has agreed to dismiss his appeal of a ruling that allowed a subpoena for testimony about the criminal prosecution of former President Donald Trump by the Republican-led committee chaired by Rep. Jim Jordan. The agreement allows House Republicans to depose former prosecutor Mark Pomerantz next month with a counsel from the district attorney’s office present.
