Good luck proving that.  The problem for the DA is the payment had nothing to do with the campaign.  It was of a personal nature, wasn't campaign money, and would have been made absent the election regardless.  Such as not wanting his wife to know which is common in these situations.

That’s the John Edwards defense that got him off on a similar charge. The difference here is that the terms of the NDAs seem be that they expired after the election. They also have testimony that Trump told them to delay making one of the payments because if they delay it to the election, they won’t have to pay at all. 
 

Those seem like fairy damming facts that might convince a jury that the payments weren’t about keeping the story from his wife. 
 

All of that being said, this is the weakest case Trump is facing. I don’t think it’s as weak as people on PPP seem to (the DA has a good chance here), but it’s not the slam dunk cases that we will see from Jack Smith and Fani Willis.

It takes a lot of cognitive dissonance to think this isn't political.  I also think it's funny that the GOP defense is he probably broke the law like many wealthy/powerful people but we live in a system where getting away with it has become normalized so he's only being charged because of who he is.  That system is part of why he was elected president in the first place.  Get your popcorn ready.

The thing is, attempting to influence an election is what its all about.  Because all candidates and their campaigns by the nature of the political process, operate with the purpose of influencing the outcome of the election.  Either things they do, or do not do.  This is how it works.        

 

Otherwise, an NDA is not illegal.

And making payments per the NDA terms and conditions is not illegal and no campaign money was involved..

And not revealing the terms and conditions or contents of the NDA is not illegal.  Revealing it would defeat the purpose of the agreement.  And there are rights to privacy affording citizens like the 4th Amendment.  

As for testimony on delaying payments.  Is there some directive in writing?  Or is the delay documented as part of the NDA agreement?  Because generally, "he said that he said" 2nd or 3rd hand type testimony can pass muster in grand jury actions where prosecutors charges are typically approved by the grand jury but in criminal court legally regarded as hearsay.

 

If Bragg wants to find somebody looking to influence an election, then he should look in the mirror.  But we all already know that's the game here.  Or maybe arrest the 51 former intelligence community members that influenced the 2020 election when they lied about the origins of the Hunter Biden laptop being Russian disinformation when they (and the FBI) knew the truth that it was authentic.  Nobody's doing time for that one.

Great Dershowitz interview at the very beginning of the show. Explains why Trump can't get fair treatment in Manhattan, what happened to him personally in his liberal social circles when he represented Trump during impeachment, why the misdemeanor is made up, the reality of TDS and why "whataboutism" is legitimate, and why any first year law student could win this case on appeal.

Im starting to believe the theory that Bragg brought this because of the Trump world decision he got a few months ago.   
 

He knows his case is bs, but he also knows he has the most biased and prejudiced juror base in the country. 
 

This should just reinforce the need for the further Balkanization of America.  If you’re a conservative, why live or do business in places that hate you? 
 

Hopefully R DA’s do the same to those in the left.  Mutually assured destruction is our only way through this after Bragg decided to light the match.
