I’ve felt from the beginning that this is not the type of counsel you end up with if you have a solid case. This slime ball always felt like a “slipping Jimmy” (for anyone who watched better call Saul). Bottom barrel scum. I feel like you don’t usually end up with them if the big boys would take your case.

Doubtful at best as far as the statutory rape goes.  She killed that with the video (and allegedly witnesses, including a friend, but the video is enough).  The gang rape, hopefully they are or at least did.  You'd think that with the national traction the story got, something would have been filed by now.

Only 297 pages huh?  Nothing like a little gang rape to get the lurkers off the couch and into the conversation.

Yes, I'm sure he's an honorable, virtuous, loving dude.  The bills don't need him or the stigma.  u mean this vid "doc"?  I doubt this girl wanted her 10 minutes of fame to be about a could be NFL punter raping her with his friends.

Shakespear was correct.  That doesn't make the poor girl wrong.  That video (gleefully on 297!) proves nothing except debauchery is rampant.  Doesn't make rape or gang rape ok.  Is it better that they might have done it to a messed up 18 yo girl?

I don’t actually know any facts of the case, haven’t followed it much at all. I am just commenting on the quality of counsel the plaintiff has chosen, and he definitely isn’t good. You usually don’t end up with this counsel because it’s your first choice. His track record has some pretty scummy cases.

As I've said before, he won't be a Bill again.  It's now a matter of following a story through to completion. 

 

As for what she wants/wanted, I have no idea.  All I can say with certainty (from the video I was actually talking about) is she lied about telling him she was 17 and as a result statutory rape is gone.  So now we wait for evidence of Araiza's involvement in the gang rape, not just a video telling one person's side of the story.

you sure seem to have taken a side; that of the future defendant.  Don't u always?  Based on a scandalous youtube video with no attribution or meaningful evidence.

people end up with Sh!tty lawyers most commonly cuz they're poor and don't know or can't afford good ones.

I believe we have proof that she told a bunch of people not named Matt Araiza that she was 18.  

 

We have no idea what she told him; just like we have no idea what happened that night.

 

That video proves literally nothing with regard to who she had sex with and whether it was consensual.

Actually the only thing we do know is that they had consensual sex outside, since they both admitted it.  They both had every reason to lie about it (her to bolster her case of him being a violent rapist and him to claim he didn't even have sex with her so no crime was committed) but they chose to admit the truth.

 

As for believing she told everyone else she was 18 but told Araiza she was 17, you're free to believe what you want.  His lawyer says he has witnesses for those who still think she admitted to being jail bait before trying to have sex with a college guy.  But as I've been saying all along, "let's see the evidence."

I think the recorded phone call about STD's is pretty damning...IF the youtube vid is legit, she's in need of therapy and I can see a college guy taking advantage for consensual sex (football player or not) but it's still awful and certainly not a character reference for him.

IDK (anything, really), but did he know something about one of the guys in that room? It was oddly specific. This could be seen as trying to help after the (sad) fact.  I don’t recall if I ever saw the exact wording. It could mean different things I suppose? 

 

I’m not making a case for either side. This is too complicated with too many unknowns for me to have an opinion. All I know is it’s horribly sad and has seriously damaged a lot of lives, including those of family members of those directly involved.  Can you imagine your child being involved in any way?

IIRC, the stuff from the phone call is hearsay since the transcripts weren't even released to her lawyer.  But even if true, it's hardly damning since he admitted to having sex with her.  And on the contrary, what rapist bothers to tell his victim she might have contracted an STD from his criminal actions?

Our “Good Son” was a freshman when we got the call. He got caught buying beer with a fake ID he got for $25. His friend Frank was from our hometown, but a different school. I had never met him, but he bailed out our son. Frank was in the wedding and we see him from time to time. He will forever be know as Bail Out Frank.

I havent been active in this thread since it was moved to OTW.  Now at 297 pages, its not something I have the time to read through.  But I am curious if there have been any news on the case.

 

Of course googling it did nothing, all the articles are weeks old because now that he is not on an NFL roster the media could care less.  But I see in this page there is talk of videos and stuff that came out.  The only thing I saw since the last time I was here was she gave an interview.  But reading some of the comments here, sounds like a video has come out on her from the night of the alleged event?  

 

So can someone just give the quick cliff notes on what's happened since he was cut, if anything?  Just wondering if anything new came out that helps his case or helps her case.

At what point does an ***** turn into a gang rape? ...and how do you prove it?

 

The party they both attended was something out of Girls Gone Wild. It is not surprising that no one remembers anything that happened that night. 

While there is clear evidence of assault/rape, I can see why the police would have a problem identifying who among the sea of degenerates to pin it on.

 

Her only hope of getting money is from her GoFundMe, which is probably why she's doing a media tour.
