Still my position has always and will always be that I don't care if he's innocent or guilty with respect to his future on the Buffalo Bills, because I don't think he should have one unless he can prove he wasn't even there.

 

Actually the attorney for the accuser in the civil lawsuit does not, in fact, have that recording as the police and the DA declined to share that evidence with him for his case. Considering the bone head went and posted her diary entry online for the world to see, can't say I blame them. 

 

So right now we only have the lawsuit summary to go on. It could be 100% true. But if you want Araiza gone solely because its probable he hooked up with a 17-year-old at a college party, so be it. Just remember even that detail hasn't been confirmed yet.

I hope Gene-1973 is okay.  I started skimming this beast and may have missed it, but I feel like I haven't seen his eyeroll in close to 24 hours.

This case was primed for major national attention. A Police Chief and DA are not that foolish. 

Matt was forecast to be an nfl draft pick based on the results around the time shortly after this incident occured.  Police would be notified by the hospital after the rape kit was done.

Criminal charges are not litigation.  LItigation is a "suit at law", a civil suit.  Criminal charges are a different system.

 

Victims do not "forgo" CRIMINAL charges.  Victims approach the police and make a criminal complaint.  WHICH THE YOUNG WOMAN DID.  The police open an investigation.  WHICH THE POLICE DID.  The investigation winds along and when it's complete, the police present the evidence to the DA's office.  The DA then decides whether or not to file charges - WHICH THEY ARE STILL DOING.  Once the victim files a criminal complaint and cooperates with the police investigation, it's out of her hands.

 

Usually a victim will not pursue civil litigation until a decision is reached on criminal charges, because being deposed for a civil suit could apparently interfere with a criminal trial.  But sometimes victims pursue civil litigation as a means to collect information that could help a criminal case and to push the police or DA to act on a criminal case.

 

So, you're making up ***** here (technical term), which makes ya look like you're going for that 'ol "victim blame" thing.

 

And Oh, by the way - female what?  Female squash blossom?  Female orb spider?  Female human?  There are words for that last - girl, young woman, woman.

There’s no reason a victim can’t pursue both criminal and civil litigation. According to some in this thread, the victim dropped the criminal pursuit because she and her family grew weary of the scrutiny, the time it takes to conduct a proper investigation, and frustration that the SDPD wasn’t concerned enough ( which I find ludicrous given her injuries). But that doesn’t mean the SDPD stopped their investigation. Victims don’t dictate that anyway.

 

I suspect the reason there hasn’t been a criminal charge made is because the SD County DA didn’t have enough solid evidence to prosecute and, like most DAs, wasn’t gonna bring anything less than a slam dunk in front of a jury.

I want him gone based on the negative publicity and distraction he's brought to the franchise in a year where we are trying to win our first championship. I wanted Cole Beasley gone last year for the same reason.

I'll withhold my judgement on whether or not I think he's guilty of rape until more evidence comes to light.

The young woman went to the police, waited 5 hrs, was interviewed by detectives, the detectives said "yeah, something bad happened here" and sent her to the hospital for the rape kit.

If the police and DA were involved in any way with making this recording without a warrant this shoukd be fired/ disbarred

Victim has not dropped the "criminal pursuit".  DA states that charges are still under consideration.

 

I suspect you're correct that the DA is hesitant because the evidence is considered questionable or incomplete.

Exactly.  What we have in the lawsuit is not an admission by Matt Araisa.  It is an allegation, by the victim through her attorney, of what Matt Araisa allegedly said during a pretext call set up by police.

 

And keep in mind - the victim and her attorney do not have access to the actual tapes of the calls.

Like I said, “according to some in this thread.” Point is, it’s not up to the victim to drop anything police or the DA may be pursuing relative to bringing criminal charges.

I mean I'm no expert but I have to believe there's a reason Araiza's criminal defense attorney believes his client is facing no charges at all, while the circumstances are different for at least one of the other accused. 

 

If the purported tape of him admitting to sex with her isn't admissible in court, that would be a big reason.
