We can cut him, try to find an exemption like the commissioner's list, he can retire, but I don't see how in the world he can be a member of our normal roster or practice squad given the allegations (unless some massive piece of exonerating evidence emerges virtually immediately). Of course it's difficult. We have white knights, chest thumpers, and bull Buchanan's running to the tree with ropes ready to lynch him. The 10% of the spectrum, both sides, dictates the rules and outcomes of all things for the rest of us because they make the most noise. That the loudest group here isn't the most popular group is telling. The loudest group wants him castrated, tarred and feathered right now. Too shortsighted to see the future holds a verdict and a man's life in the balance. 3 1
aristocrat Posted August 27, 2022 Posted August 27, 2022 So I think the bills attorney may not have communicated to mcbeane exactly what happened. I’d have to assume he spelled out what happened to his client pretty clearly cause he doesn’t seem like a guy who is going to sugarcoat anything. the bills attorney also spoke to araizas attorney as well and she must have gotten some pretty good intel that Matt and them would be in the clear. It would seem she simply gave them some info that a girl was raped and Matt was there but not involved. Then the story comes out as to how vicious the assault was and now you have the shock the staff is in.

Big difference between formal, criminal murder charges from the state and a civil lawsuit being filed by an attorney whose actions to this point have been dubious at best. Anyone can file a civil lawsuit about anything and allege whatever they want in the summary. 2 1

I'm not super interested in the tangential argument on here that seems to be dripping with pseudo-partisan culture war language. What I'm saying is the press that comes with this is untenable for a massive brand like the Buffalo Bills. To simply trot out Matt Araiza for the duration of this litigation is not an actual option. I think that notion is more of a hypothetical being used on a message board for folks (not necessarily you) to take their argument to the extreme. 1

I don't necessarily agree with the Patriots cutting him at that point, either. Also, criminal charges were filed, irc the charges were only a short time after the murder. It's been almost 10 months in this and no charges. If araiza is charged the situation changes. He maybe actionable by the commish since the action of the charge occured while an NFL employee. That's speculation. Further, Hernandez was specifically charged with first degree murder. Araiza is a suspect for what we know to be at worst having sex with a minor, which per CA law may not even be a felony. The law reads it could literally be any which way. DC Tom broke it down elsewhere when he got curious and stated it could and would likely be a misdemeanor charge of indecent liberties with a minor instead of felony rape

As you might expect, there is current content. Yeah, sometimes finding the truth gets messy. Jumping to a conclusion can also create more "circus" Thanks for the link. I didn't give it a lot of time but I did 3 searches and didn't find anything. I bit the bullet for $1 6-month subscription and read the LA Times article that came out June 3, 2022. Some excerpts: Quote The reports to campus officials late last year revealed disturbing allegations about players from San Diego State University’s winning football team. Claims were rapidly spreading among the school’s athletes that five players had raped an unconscious girl and left her bloodied and bruised at a house party off campus. “I am very scared and worried that nothing is being done about this,” one student-athlete told university officials in a message sent through an anonymous reporting system, which was reviewed by The Times along with other internal campus records in the case. Quote The university noted that it was not required under federal law to send out a crime alert to the school community because the incident occurred at a private home off campus. Experts, however, said some other universities have sent out notifications about sex crimes in similar circumstances and that a school can work with police to determine what measures can be taken to notify the campus and ensure the safety of students and employees. Such measures could include sending out a general message to reassure students that allegations are under investigation and provide information on accessing campus resources and contacting police, experts said. University officials, they said, could also monitor or restrict the activity of students suspected in the incident. Before police formally asked the San Diego State president to delay its investigation, some campus officials privately discussed the pressing need to launch an inquiry and that they couldn’t “continue to do nothing while SDPD takes their time,” according to the internal records reviewed by The Times. Quote Cal State records reviewed by The Times show that officials said the alleged rape occurred on Oct. 16, one day after the football team beat rival San Jose State in a Friday night game. One day after the football team beat rival San Jose. Yeah, the football players weren't having a party, just a little gathering. Sure, Counselor! Quote Three days after the alleged rape, San Diego State President Adela de la Torre and other campus officials learned of the accusations after police contacted the university. A university spokeswoman said De la Torre was not available for interviews for this report. Quote On Oct. 26, a message sent through the anonymous reporting system was reviewed by Jenny Bramer, the university’s executive associate athletic director and deputy Title IX coordinator: “5 football players raped an unconscious girl at a football party two weeks ago.” Quote “I suggest that the head coach is spoken to and the football players. They know who did it and I am sure they know who the girl is,” the student-athlete told Bramer, adding that “multiple student athletes” were aware of the accusations. The student-athlete, who described being frightened about being identified, provided the name of one of the football players, a senior, and said the others were freshmen, according to the records. Quote That night, a second anonymous report from a student-athlete came in regarding “very disheartening and disgusting information” that was “spreading quickly” in the athletics department. This student-athlete also was not present at the home during the party but reported hearing similar accusations, including that the alleged victim took a rape kit. The student described being frightened and concerned that coaches were “trying to sweep it under the rug because our football team is doing so well.” “99% of the football players are aware of the 5-person rape so the rest of the student-athletes are left wondering why nothing is being done,” the student said My point in quoting all this is to point out that when vetting QB's, apparently the Bills scouts and investigators (among others) were able to gather info from teammates, coaches, athletic trainers, and athletes in other sports that maybe "Chosen Rosen" wasn't beloved for his attitude and interpersonal interactions around the athletic department. It sounds as though there were plenty of rumors and concerns about a rape around the athletic department, the name of a player potentially involved was known, and "99% of the football players were aware of it". Some administrators were aware of the police investigation. It kind of seems to me that an area scout or investigator worth their salt should have picked up on this? 1

But...... “His admission was the thing that, when I started reading about this case, that just jumped out,” Dallas-based attorney Michelle Simpson Tuegel told the Democrat and Chronicle on Friday afternoon. “I was like, ‘Whoa,’ because there are a lot of cases I handle where we don’t have that kind of what I would consider bombshell evidence.” Based on what she has read in the lawsuit, “I think it’s enough for them to charge him with a crime,” Simpson Tuegel said. “As a criminal defense lawyer or as a lawyer who now represents victims and has for years, I would say that is an admission and a problematic statement for him. He made an admission and she’s under age. I just don’t know how you get around those facts. That’s a real problem.” 2

mbossman2 Posted August 27, 2022 Posted August 27, 2022 One thing that does not appear to have been mentioned: If the alleged victim was 17 at the time of the alleged crime (which is what news reports are saying), that puts her under the age of consent in California which immediately puts sexual contact between someone above the age of majority and someone under 18 as rape. I was discussing this with someone this morning and he said "if this was my daughter, that kicker wouldn't have seen another sunrise" 1
