UPDATE: CASE DISMISSED

 

 

TMZ is just all over us lately!  This one isn't for the right reasons, though.

"Von Miller is being sued by a woman in Los Angeles who claims the NFL star, consumed by rage and jealousy, distributed a sexually explicit photo of her to "two well-known celebrities" in May 2020, TMZ Sports has learned."

 

 

Doesn't sound like much will come of it.  Seems like a really bad breakup.  Not a great look, though.

Can call it defamation even if they consented to it. Unless he has proof they did, I'd expect an out of court settlement.

Here's the law in CA

 

California has specifically outlawed "revenge porn." In California, it is a crime to post or otherwise electronically distribute a digital image of another person in order to harass, cause fear in, or lead to injury of that person. Revenge porn, sometimes called "cyber exploitation," is a form of nonconsensual pornography (NCP). Although disgruntled exes are frequently the perpetrators of revenge porn, strangers also commit NCP by hacking into others' accounts or devices and then posting images they find.

 

Harassment By Means of Electronic Communication

 

Anyone who uses an "electronic communication device" (such as a cell phone or computer, see below) can be charged with a misdemeanor in the following circumstances:

 

Distribute or send. The law makes it illegal to distribute, post, email, or otherwise disclose any personal identifying information, including a digital image, of another person without consent; or to send a harassing message.

 

Likely effect, on whom. The law applies when the distribution or sending would likely incite or produce harassment by a third party.

Intent of the distributor or sender. 

 

The prosecution will have to prove that the defendant intended to place another person in reasonable fear for his or her own safety (or that of an immediate family member).

 

(Cal. Penal Code § 653.2.)

Any individual who engages in harassment by electronic communications may also be charged with misdemeanor stalking under California law. (Cal. Penal Code § 646.9.) For more information about stalking, see Harassment and Cyberbullying as Crimes.

 

The California statute defines the terms used in the statute, as set forth below.

Idk how each state and situation handles it.

 

what if he was in Denver but photos we’re sent to someone in NY which area could they file the lawsuit/charges

I take it you have all the details and facts?  It could be 100% true, it could be a lie to extort a settlement out of someone who just got handed tens of millions of dollars.

 

I'm going to go out on a limb here and guess that based on your knee-jerk outrage over this, you've had something similar happen to you.

I figured the way it’s worded they’re saying it’s “revenge porn”.

 

Either way if he did it as they say then he’ll have to settle.

Yeah….. My dick ended up in a video on pornhub after an ex ended up trading her old phone for drugs years later…. This isn’t even a blip on my radar. If you consent to pics expect them to end up being seen by others. Fact of life in this digital age.
