Last year, there was a bit of a stir when Justice Alito cited Sir Matthew Hale in the Dobbs draft, as ultimately in the published opinion. The well-known seventeenth century English judge sentenced two women to death for witchcraft. Therefore, everything the jurist wrote should be cancelled. For those who still care about these things, Justice Sotomayor’s dissent in Pugin v. Garland, which was joined by Justices Gorsuch and Kagan, also cites Hale. She cites Blackstone too. I’m sure he said some misogynistic things. . . . Kagan had cited Hale in the past as well. Is there a problem? Hale no. Why is the Court suddenly controversial? Obviously because it is, at the moment, in the hands of relatively conservative justices. Democrats revere the Court when it is ruling their way. When they lose a few cases, they stir up bogus “ethics” controversies. Not because they have any merit, or because any knowledgeable person takes them seriously, but so that they can generate endless headlines in Democratic Party news outlets about the “controversial” Court that supposedly is dogged by ethics charges. This will undermine the Court’s stature in the eyes of the uninformed, and perhaps cause justices to take a more liberal turn in order to turn off the heat. It is ironic, of course, that the Democrats are peddling fake ethics attacks on Republican-appointed Supreme Court justices at a time when their President is accused, with a great deal of evidence, of taking multi-million dollar bribes from foreign governments and interests. No ethics problem there! The Democrats’ most recent volley is against Justice Samuel Alito. What did he do? Fifteen years ago, he hitched a ride on an airplane to go fishing in Canada. So what, you ask? So nothing. The Wall Street Journal gave Alito space to respond to the attacks levied against him by far-left mouthpiece Pro Publica. Alito’s response is devastating, and fun to read for that reason. I encourage you to follow the link. This should’ve been brought up a lot sooner. Honestly, if some GOP muckraker wants to find similar scandals with the liberal justices, I’d be pretty happy with that. We need serious SCOTUS ethics reforms and they won’t happen so long as the questionable activity is just on one side of the aisle. 1 1

B-Man Posted July 3, 2023 Posted July 3, 2023 Let's Take a Moment to Appreciate Clarence Thomas' Three Decades on the Supreme Court After an eventful and historic end to the Supreme Court 2022-2023 term, I think it might be time to take a moment and simply appreciate the current Senior Associate Justice, Clarence Thomas. If you recall, he was nominated by George H.W. Bush in 1991, and coming up at the end of October this year, he will have served a total of 32 years on the High Court.
