Oh Hale Yes! Justices Sotomayor and Kagan cite Sir Matthew Hale.

 

Last year, there was a bit of a stir when Justice Alito cited Sir Matthew Hale in the Dobbs draft, as ultimately in the published opinion. The well-known seventeenth century English judge sentenced two women to death for witchcraft. Therefore, everything the jurist wrote should be cancelled.

 

For those who still care about these things, Justice Sotomayor’s dissent in Pugin v. Garland, which was joined by Justices Gorsuch and Kagan, also cites Hale. She cites Blackstone too. I’m sure he said some misogynistic things. . . .

 

Kagan had cited Hale in the past as well. Is there a problem? Hale no.

 

Last year ProPublica–yes that ProPublica–assailed Alito for quoting “infamous witch trial judge with long-discredited ideas on rape.” I’m waiting for that venerable new organization to discover any Justice who was appointed by Presidents Obama or Biden.

Why is the Court suddenly controversial? Obviously because it is, at the moment, in the hands of relatively conservative justices.

 

Democrats revere the Court when it is ruling their way. When they lose a few cases, they stir up bogus “ethics” controversies. Not because they have any merit, or because any knowledgeable person takes them seriously, but so that they can generate endless headlines in Democratic Party news outlets about the “controversial” Court that supposedly is dogged by ethics charges. This will undermine the Court’s stature in the eyes of the uninformed, and perhaps cause justices to take a more liberal turn in order to turn off the heat.

 

It is ironic, of course, that the Democrats are peddling fake ethics attacks on Republican-appointed Supreme Court justices at a time when their President is accused, with a great deal of evidence, of taking multi-million dollar bribes from foreign governments and interests. No ethics problem there!

 

The Democrats’ most recent volley is against Justice Samuel Alito. What did he do? Fifteen years ago, he hitched a ride on an airplane to go fishing in Canada. So what, you ask? So nothing. The Wall Street Journal gave Alito space to respond to the attacks levied against him by far-left mouthpiece Pro Publica. Alito’s response is devastating, and fun to read for that reason. But of course, the Democrats don’t really intend to win any arguments over the Republican justices’ “ethics.” Making the attacks, however absurd they may be, is simply a cover for Democratic Party news outlets to push the theme that the Court is now “controversial” and its justices–only the Republican ones, of course–are somehow shady.

There’s one thing I agree on on this and that’s that I don’t know why this has not been brought up sooner
 

What the Supreme Court has been doing whenever they have cases in front of them that literally they are conflicted on has been going on for a while and we’re just now bringing it up. This should’ve been brought up a lot sooner.

Honestly, if some GOP muckraker wants to find similar scandals with the liberal justices, I’d be pretty happy with that. We need serious SCOTUS ethics reforms and they won’t happen so long as the questionable activity is just on one side of the aisle.

The coordinated and sophisticated attacks on conservative Supreme Court Justices Samuel Alito and Clarence Thomas are no accident. This is a deliberate campaign to tarnish the reputation of justices and delegitimize their decisions in the eyes of citizens.

 

These attacks are long on rhetoric and short on substance. But that’s how the game is being played. Lacking actual proof of wrongdoing, the left has taken to insinuating ethics violations.

If the tactics of the left in attacking Supreme Court Justices seem vaguely familiar to you, you’re correct.

 

“This is a textbook example of one of the Left’s favorite tactics: the pop-up pressure campaign,” Thayer explained. The left, through their media outlets and social media presence, creates the appearance of a political groundswell coming from the bottom up when actually, it’s a top-down effort all the way.

 

“It’s easy to spot once you know the secret,” he said. “First, one or two donors pay a legion of different organizations to get involved in a certain policy debate. Then, all at once, these groups start making noise about an issue nobody cared about five minutes ago.”

 

ProPublica claims that “40,000 people actively fund our investigative, nonpartisan journalism. Our newsroom operates with fierce independence. No donor or board member is even aware of the subjects of our stories before they are published.”

 

That’s no doubt true. But it’s also true that a huge portion of their funding comes from a few Democratic billionaire donors who give to ProPublica because they can be relied on to smear the conservative opposition and support the far-left agenda of their benefactors.

Let's Take a Moment to Appreciate Clarence Thomas' Three Decades on the Supreme Court

After an eventful and historic end to the Supreme Court 2022-2023 term, I think it might be time to take a moment and simply appreciate the current Senior Associate Justice, Clarence Thomas. If you recall, he was nominated by George H.W. Bush in 1991, and coming up at the end of October this year, he will have served a total of 32 years on the High Court.


What a damn fine run it has been.
