I think that's called the "null hypothesis". You shift the burden of proof by demanding your opponent prove the unprovable, then declare victory when they can't. It's a tactic frequently used by theists in debates with atheists ("Prove there is no god...oh you can't?...then I win, atheism destroyed!"). 1
