Yes he committed a crime.  If he gets off because the cops and the DA screwed up the case, so be it.  That's on them.  They made a mess of this whole operation from the beginning.  If he walks, meh...it's a handjob.  It's not like he nearly decapitated his ex wife and another guy.

 

If the video is suppressed there is no case.  And if the video is suppressed because it was improperly warranted and executed, the Sunshine Laws won't apply, so it can't be legally released.  So in that circumstance, yeah, he likely will have it "both ways"----although I'm betting that, given what we now know about his preferred massage predilections,  I'm sure that's what he asked for each time he visited that place:  "i'll have it both ways please".

Highly paid prominent attorneys playing hardball. What's the surprise? The prosecuting side is just as capable of fighting back against the men who wear more expensive suits. There is going to come a point where the judge is going to get exasperated with these guerrilla war legal wrangling over a low caliber violation that is taking up a lot of his court's time and resources. It is going to be interesting to see which side his ire is going to be directed towards.

the judge can just toss it out or he can get pissed they are wasting his time and throw the book at him.   

 

Someone should sell the video to the highlight bidder and give the money to charity

The video is in the custody of the authorities. Anyone involved with the selling of evidence is committing a crime and will be held accountable.

This whole thing is interesting because I can remember when someone that was into watching other guys have sex was considered a pervert. Now with internet porn it is promoted to the masses as healthy entertainment-so much so that people are bragging/excited that they are going to be the first to watch Kraft get jerked. Pretty wild.

Actually, if you read the article, Krafts lawyers, while questioning the cop on the stand in front of the judge and the prosecutor, accused him of fabricating a reason for the traffic stop.

 

And actually:   "Prosecutors said to avoid telling the man that his traffic violation had occurred in the spa's parking lot, Kimbark was recorded telling another officer that if the man asked about its location he would "come up with something."

 

So it's hardly a difficult line of questioning for the cop. 

 

Also: "Burck in his phone interview laughed at the accusation, saying prosecutors were present during Spiro's conversation with Kimbark."If they thought it was such a terrible thing, it is interesting that they decided to raise it a week later and not right after it happened in front of the judge,"

There is a big difference in this case with the Kardashian and Jersey Shore naughty guys and girls. In this Florida Kraft case it would be someone in the legal system selling evidence. I don't want to come off sanctimonious but that is illegal and corrupt. Just because Kraft is rich that doesn't mean that he should be treated corruptly by the legal system. In the grand scheme of the judicial system this is a miniscule and a nuisance case. In my view the authorities are acting out of proportion to the scale of the offense. It's a waste of time and resources. This case should be dropped. Don't believe in the concept of the purity of the law. Discretion and judgment are part of the fabric of the system. Just as it is in horse racing!

If you get pulled over leaving a Rub and Tug do you go back the next day?   This is stupidity  and yeah I like laughing at it.
