NDA's can be overly-broad, though...and I think the one Trump's staffers got may have been. NDA's I've seen are usually crafted to protect privacy info, intellectual property, or competitive information. One is free to challenge anything they have entered into as a contract, it often leads to a reduction depending on many variables. This is not the same as declaring that all NDAs by nature violate the 1st Amendment.... accounting firms have sought to impose them, along with non-competes, on people leaving firms, it rarely holds for those below the partnership level though.
