He was technically a private citizen at the time, not just talking to Russians but setting foreign policy which, as a private citizen, he cannot do. I'm not sure that legal hair-splitting has ever been applied before - Obama, for example, did a foreign policy tour of Europe as part of his 2008 campaign, and talked to a good number of European leaders. It's a significantly grayer issue than Flynn, since Obama was a sitting Senator and on the Senate committee for Foreign Relations, thus entitled to "fact-finding" visits to foreign countries...but it was explicitly part of his campaign, so not entirely honest either.
