That's not the standard Patriots' excuse model. The standard is:

 

1) he didn't do it

2) IF he did it (but he didn't), then it didn't give him any kind of competitive advantage

3) IF he did it (but he didn't), AND IF it gave him a competitive advantage (but it didn't), then everyone else is doing it too
