If you are the Bills, do you want him playing vs the Colts and risk having to serve his suspension later in the season? Or do you figure we need him the most now?

Folks, I said this in another thread. There are going to by a myriad of challenges now made by players arguing that their suspension is in direct violation of the CBA. Dareus included. Basically, anything for which there isn't otherwise a precedent. Drug suspensions will remain of course, but for everything else, it's going to be a disaster.

I just found that too. It was synthetic weed. None the less, if that's not specifically on the list of banned substances, he would have the same argument of lack of advanced notice. Fun to think about how the players are going to go after the NFL for this judge's gaffe.

It is - he will have an uphill battle to claim he was not aware of a potential penalty. He should take the penalty and move on. Brady won in a court of law but loses because he is once again shown to be a part of a cheating organization. I want Dareus back for the Patriots game simply because it will be nice to see the Bills beat the cheats. Let's not win because their cheating QB is whining while off on suspension.

Which wasn't illegal at the time.

 

Whether it's illegal or not is irrelevant. The question is whether it was on the NFLPA's banned substances list.

My point remains the same anyway. Players can get suspension for PLENTY of substances that are legal. What matters is what's listed in the NFLPA, not what's allowed by the law.

Did Dareus receive advance notice from the league that he could be suspended for a game for driving too fast?

 

I thought this suspension was for "substance abuse" - the arrest for synthetic mary jane which is illegal in Alabama***

 

***(and stupid everywhere - public service announcement to anyone considering it, the people making that stuff are into money and skirting the law, not into ensuring that the changes in chemistry that keep it legal don't f*** your body up.)

Dareus described it as a "banned substance". The NFL, as always, did not say what the subtance was. Says right in your 2 references.

The article also notes that "found him to be in possession of synthetic marijuana and drug paraphernalia, both Class C felonies that carry a minimum one-year jail term had he been indicted and found guilty at trial" and "Last May, Dareus was arrested for felony possession of a controlled substance and possession of drug paraphernalia" which sounds to me like it's illegal

 

But your point is well taken that suspension correlates to the NFL's banned substances, which may or may not be illegal
