Or Somebody tampered with the kit and threw it in the face of the girl's mother? Sorry, I'm at work so I've just read snippets of what's going on.

At this point, one of those seems to be the logical jump. Which? Don't know. A tampered kit makes a conviction real hard though, I imagine.

Brilliant... I was wondering how they would play this... He's learned a lot from dealing w/the porn world! A tampered kit makes a conviction real hard though, I imagine. That's not what Cambria is saying. He is saying this hurts Kane more! Somebody didn't like the evidence... Brilliant, now Kane's the victim!

There's only one possible response to the kit being left on her door and that is exactly what happened. It goes public and then even more investigation begins. So if someone actually did this to intimidate, they are incredibly stupid.

Even the stuff that hurts Kane, like the DNA on the shoulder (supposedly where the bite marks are?)... I mean the evidence is all gone, totally FUBARRed.

How could that kit have made its way to the accuser's mother's doorstep? Are the police going to claim that someone stole evidence in an investigation or that they released it to someone?

Keep in mind, criminal burden of proof is "beyond a reasonable doubt" (and without the DNA evidence, high profile defendant, he said/she said, the case is a loser). On the other hand, the civil case can go forward as the burden of proof is "by a preponderance of the evidence" (meaning it is more likely than not that he committed an intentional tort of battery/assault. The !@#$ up with the rape kit will bear on credibility of the witnesses, but the driving force of a civil case will be each of their stories.

We've all seen enough CSI to know how that stuff works. Hell, we were reminded how destroying evidence works in favor of the accused in the Tom Brady case, when he destroyed his phone. Weak... He could nave raped her with his hand, object, etc... ? There was still the DNA on her shoulder, finger nails, etc... SUPPOSEDLY! Now that is all tainted too! Or he's doing his job. Who? And now there is the evidence bag at the front door. There are 1000 potential stories and that is one. To me, this has to be in the top 5 or so most plausible.
