HILLSBORO, Ore. (AP) — An Oregon judge has ruled that a 61-year-old man did nothing illegal when he crouched in the aisle of a Target store and snapped photos up a 13-year-old's skirt.

It was lewd and appalling, but not outlawed, Washington County Judge Eric Butterfield said.

"From a legal point of view, which unfortunately today is my job to enforce, he didn't do anything wrong," the judge said Thursday.

Patrick Buono of Portland didn't dispute using his cellphone to take upskirt photos on Jan. 3 at the store in suburban Beaverton, The Oregonian (http://bit.ly/1zXl9hx) reported.

But his defense lawyer, Mark Lawrence, argued Buono didn't violate the laws against invasion of privacy and attempted encouraging child sexual abuse, a child pornography count.

The privacy law bans clandestine photography in bathrooms, locker rooms, dressing rooms and tanning booths, but the Target aisle was plainly public, Lawrence said.

Upskirt sightings can occur by happenstance, he said, citing a famous photo of Marilyn Monroe with her dress flying up. And that could happen to someone riding up an escalator, taking a spill or exiting a car, he said.

"These things are not only seen but video-recorded," Lawrence said. "It's incumbent on us as citizens to cover up whatever we don't want filmed in public places."

On a lighter note, it did happen to take place in Beaverton. :bag:

This is sad. The guy clearly crossed a line of decency. This judge can jam his interpretation of 'happenstance' as it pertains to this law. This was done on purpose by a pervert....to a very young teenage girl.

 

"It's incumbent on us to cover up whatever we don't want filmed in public." - ??? How does one better cover up while wearing a skirt/dress? Should she have worn a big pair of bloomers underneath?? The guy crouched down and stuck his phone under her skirt to snap a photo....and it's because she didn't 'cover up?' :wallbash:

Most of those quotes are from the dirt bag lawyer, not the dirt bag judge, but the dirt bag judge did end up ruling in favor on the dirt bag offender.

 

Isn't there some possession of child porn charge that would apply? If they can't charge him for taking the pictures, can they charge him for simply having them?

In a way I agree with him. Upskirt is not my thing and that the dude was creeping on some teen is just messed up but she was out in public. This form of porn is growing rapidly, sadly. There isn't much that can be done to stop it because banning it is going to create a major grey area of what is legal and not. Is taking pictures of the local lake where it just so happens that someone is swimming in going to be a illegal? Is the woman taking a picture of a bounce house going to be labeled a sex offender because some kids are in there and there just happens to be something extra showing? Is a man going to be in the wrong taking a picture of his cousin or daughter if there is an accidental nip slip in her tube top?

 

You can say there is common sense in the world and people need to have it but clearly this world lacks it and letting a courthouse get free reign on common sense is not something I am comfortable with having. I want common sense to begin at the house, inside our own walls. Whats right to wear and how to wear it needs to be addressed.

 

Of course, if I caught someone taking creep shots of some kid they might not end up walking away too easily.

Just out of curiosity, but a guy sneaks a photo of a 13-year-old's panties and you're justifying that because she was out in public. What if the guy got consent from a 13-year-old girl (not from her parents, just from the girl) to pose in her underwear out in a park so he could take photos of her and post those to websites for people who like that kind of thing.

 

Still okay? I mean, they have her consent and she's in public, right?

I am not saying it is ok. I am not excusing it because that's just messed up. I am saying that legally it is just a very grey area that I would rather not have. I don't have the answer on how to prevent it, maybe wearing some spandex shorts under the skirt or not having such a skimpy skirt? I am not blaming the girls for what they wear but merely saying that if you want to protect your privacy you need to protect your privacy.

 

If a man gets a 13 yr old to pose in a park then I will first wonder where her parents are and wonder what upbringing she has had. If it was my girl I would then wonder where I would bury the guy so no one would find him.

 

Also, in such an event there would likely be other charges applicable but I am not a lawyer.

one of the few laws of the internet is rule 34. If it exists there is porn of it. Sure 20 years ago things were different but we still had people like we do today. Crossdressing perverts who rubbed one out to pictures of old ladies farting in cakes, for instance. So to say no one upskirted Hillary, I call BS. Google it, dare you.

 

I have seen more on the internet then 99.9% of the members of this place. Not all of that porn, either. But, there are a lot of creeps out there. You simply can't stop them.

Not really. If I want to see a vagina, there are about a million different ways to find them without having to settle for what is essentially a grainy, dark, black and white image that looks like it was taken through the bottom of a Coca-cola bottle.

 

That's why I suggest it's *mostly* the thrill of taking the photo that motivates those who like this kind of thing, not the actual photo itself.

 

Besides, I'm a breast guy anyway.
