I didn't see the video to see if there was another car in the right lane that he needed to pass

 

Fair enough...although I'd assert that even if there were a vehicle in the right lane, he doesn't need to pass at all...and that is the crux of the problem. I'm not saying it's innate or easy, but he can choose to control his emotions and be patient. Feeling the need to drive faster than someone else is what got him into the accident.

But we also don't what was happening before she started shooting the video, The guy obviously pulled a douchey move. But how long was she hogging up the left lane and how fast was she going. I have had several instances where I catch up to a slower car in the left lane and wait for them to pull over. There are times when that car is stuck in the left lane, come hell or high water with a ten car caravan behind them. Now, who's creating a traffic danger in that case?

 

Many times, it's as basic as people forgetting or never learning the basics of driving - look to the 2nd or 3rd car in front of you, not the one directly in front, always have an out, and check your fricking rear view mirror every ten seconds. Invariably, in my experience that left hugging driver is not doing all those.

I respect what you're saying...again, 2 separate issues:

 

1) Yes, that woman is driving dangerously and has no business doing so

 

2) The man reacted poorly and displayed no self control, causing his own accident

That is a wrong interpretation. He was more in danger if the op did nothing @ all. He was wearing headphones, his hearing and spatial perception was impaired... See my story above about the girl on the bicycle... She heard nothing, even all that loud noise around her... In her own world! Now in this story, if the boot would have never got his attention, he may have turned right into the train... REALLY! It is a long train. If you notice, he swept his saftey shoe towards his side of the head, the kid wouldn't have turned into the train. He did come back that way, but didn't tip towards the train. What he should have done is push him AWAY from the train, face first into the ballast (rock @ the base of the track). Not sure if he was trying to do it, hard to do on a moving train when you got one chance.

The kid may have gotten pulled under but it is pretty clear that without the conductors quick thinking he would have gotten his head caved in.

whatever the intention, the act of kicking him could have caused his death or a dismemberment - resulting in a charge of Involuntary Manslaughter.

 

the question remains - Get involved or let nature run its course?

In my Ares in the last 14 months 3 teens have died with similar stupidity.

 

In the big ice storm a few weeks ago a kid was walking with headphones on a train tressle and got whacked. Lived for 2 hours, awake, too.

 

Last Fall I think it was, a kid was walking on the rail with headphones on when he caught am Amtrak to Charlotte.

 

And last Spring a kid was riding a 4wheeler and got clipped at what they think was trying to race the train.

 

All were under 20 years old and within. 20 miles from my house. All on the same railway

from the story he "thought" he was a safe distance away and from the video it looked only to be 1 locomotive (engine) car.

 

playing near train tracks is never a good idea.

In civil court she might get some liability.

In the eye of the public she is guilty - not by majority, perhaps but a minority is all it takes.

In the eye of right and wrong she is also guilty and wrong.

I'm at 70-75 mph w trailer on posted 55 mph highways all day long. Slower traffic keep right is the play and signs notate that everywhere (especially when you get closer to nova) Speed limits on interstates should be raised jmo.

 

GTFO the way....there are 3-4 lanes. No reason for you to be anywhere near the left one if the speed limit scares you. Some of us actually have things to do.

And even if all of that is true, please explain why he needed to react the way he did and cause his own accident....still waiting on that one from the folks that are defending this guy.

 

Once more: his actions are his responsibility. Her actions are her responsibility. Neither of them acted properly; just so happens he's the one that got the worst of it.

Wow... This is just plain troubling that people think like this. I am not timid, I am not scared... I have no problem going 75, 85, or 105. I guess I am naive, I just never thought this is what we are dealing with out on the roads. Wow... Maybe people can call me old (46), but I never thought like this even when I was 16, 26, or 36. I wonder where this attitude comes from? If there is anything that is scary... It is Ryan's and NDBuffCuse's train of thought and total disregard for the law through their own immaturity and selfishness. Crazy to say the least.

Being candid here, this is one of the reason why I have a hard time sending my child out driving @ 15 (learner's permit is 15 in Illinois). Once he gets past the learner's permit phase, he may feel the need to "compete" with the immature douchebags that feel the world revolves around their happiness. It isn't that I feel he would be unsafe on the road... It is just that I don't want to unleash a self-centered 15 year old prick out onto the world and make others unsafe. That I have a hard time dealing with. It would crush me more finding out his objectivism wiped out a family. I could handle his death @ the hands of chance better than his immaturity causing a terrible accident. A bit harsh calling my child that? Yes, but is what is @ that age. The world revolves around them, they are invincible. Objectivism is an immature thought process, I just always hoped and prayed people grew up... I guess not.

I have ZERO driving accidents while SPEEDING and I've been at it for over 30 years.

 

Rule # 1 - Always expect the worst from the idiot in front of you and occasionally behind you.

 

Let the speeders pass or get off the road.

 

my biggest pet peeve idiots driving slow because it just sprinkled and the road is wet!

 

hell this AM some duesch (guy) was picking at a zit on his cheek and (a) when traffic started to move at the green light didn't move for 10 seconds and than drove 30 in a 55

 

shave at home, put your makeup on at home, pick your zits at home and don't make my 50 minute commute 75 minutes or more

I don't understand, there is no attitude it's a very simple formula. Slow right left fast = peace and harmony

 

Dumb slowpoke doesn't follow the rules = no peace no harmony.
