If your concern is that the union and the company are supposed to have a symbiotic relationship & the practice of handing over ownership of the company to the union when the company fails upsets the balance of that relationship by removing the union's incentive to see the company survive, you're not going to make much headway with the usual suspects. Sure it's a perversion of justice and a potentially destructive precedent, but these guys think it's all rightly property of the government anyway.
