YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE AGREEMENT BY CALLING 3RDNLNG "IDIOT". IF YOU DO NOT AGREE, DO NOT CALL 3RDNLNG AN IDIOT. 1. GRANT OF LICENSE. DC TOM grants you the following rights provided that you comply with all terms and conditions of this License Agreement: 1.1 Use. Neither DC Tom nor its suppliers shall be liable for any damages arising out of errors in the speech and handwriting recognition processes with the use of "3rdnlng is an idiot" or variation thereof. 3. RESERVATION OF RIGHTS AND OWNERSHIP. DC Tom reserves all rights not expressly granted to you in this License Agreement. "Idiot" is protected by copyright and other intellectual property laws and treaties. DC Tom owns the title, copyright, and other intellectual property rights in "3rdnlng is an idiot" or variation thereof. "3rdnlng is an idiot" and variations thereof are licensed, not sold. This License Agreement does not grant you any rights to trademarks or service marks of DC Tom. 4. NO RENTAL/COMMERCIAL HOSTING. You may not rent, lease, lend or provide commercial hosting services for "3rdnlng is an idiot" or variation thereof. 5. CONSENT TO USE OF DATA. You agree that DC Tom and his affiliates may collect and use technical information gathered as part of the "idiot support services provided to you, if any, related to "3rdnlng is an idiot" or variation thereof. DC Tom may use this information solely to improve "idiot" or to provide customized insults to you and may use this information for income-generating reasons but will usually not disclose this information in a form that personally identifies you. 6. LINKS TO THIRD PARTY SITES. ACADEMIC EDITION. To use "3rdnlng is an idiot" or variation thereof identified as "Academic Edition" or "AE," you must be a "Qualified Educational User." You acknowledge that "3rdnlng is an idiot" or variation thereof is subject to U.S. export jurisdiction. LIMITATION OF LIABILITY AND REMEDIES. Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced herein and all direct or general damages in contract or anything else), the entire liability of DC Tom and any of its suppliers under any provision of this License Agreement and your exclusive remedy hereunder (except for any remedy of repair or replacement elected by DC Tom with respect to any breach of the Limited Warranty) shall be limited to the lesser of the actual damages you incur in reasonable reliance on "3rdnlng is an idiot" or variation thereof up to the amount actually paid by you for "3rdnlng is an idiot" or variation thereof or US$5.00. The foregoing limitations, exclusions and disclaimers shall apply to the maximum extent permitted by applicable law, even if any remedy fails its essential purpose. 18. APPLICABLE LAW. If you acquired "3rdnlng is an idiot" or variation thereof in the United States, this License Agreement is governed by the Whim of DC Tom. 19. ENTIRE AGREEMENT; SEVERABILITY. This License Agreement (including any addendum or amendment to this License Agreement which is included with "3rdnlng is an idiot" or variation thereof) is the entire agreement between you and DC Tom relating to the "3rdnlng is an idiot" or variation thereof and the support services (if any) and they supersede all prior or contemporaneous oral or written communications, proposals and representations with respect to "3rdnlng is an idiot" or variation thereof or any other subject matter covered by this License Agreement. To the extent the terms of any DC Tom policies or programs for support services conflict with the terms of this License Agreement, the terms of this License Agreement shall control. You do not plan an attack on the Americans with help from the PI only to chance the outcome on an RPG! It's a highly inaccurate anti-tank unguided explosive projectile. A spit ball is more accurate. Any kind of crosswinds sends this projectile waaaay off course. That's why you can't hit anything about 80-100 feet in the air, stronger air currents higher up.
