The key phrase in the story isn't "18 year old". It's "student". Still...it's a hell of a punishment for legally consensual contact.

The article doesn't state that the 18 year old is a current student of her's (unless I missed it). What if he is a former student of hers but no longer attends any of her classes? What he is has never been her student but is a student at her HS? What if he's a student at a different HS? Lewd acts in puclic apply in each case, but what about having an improper relationship with a student?

Which doesn't mean the article isn't wrong or badly written, of course... What if he is a former student of hers but no longer attends any of her classes? Okay. What he is has never been her student but is a student at her HS? Not okay. What if he's a student at a different HS? Okay. Lewd acts in puclic apply in each case, but what about having an improper relationship with a student? "IMPROPER RELATIONSHIP BETWEEN EDUCATOR AND STUDENT. An employee of a public or private primary or secondary school commits an offense if the employee engages in sexual contact, sexual intercourse, or deviate sexual intercourse with a person who is enrolled in a public or private primary or secondary school at which the employee works." But if you're married to the student, that's an affirmative defense.

A little common sense and discretion would likely have kept the impropriety a secret. Not saying it makes her actions correct only saying that at the end of the day she is in trouble in part simply because she is stupid.
