Yep. The key phrase in the story isn't "18 year old". It's "student".

 

Still...it's a hell of a punishment for legally consensual contact.

Has nothing to do with adulthood. Has everything to do with a student-teacher relationship.

The article doesn't state that the 18 year old is a current student of her's (unless I missed it).

 

What if he is a former student of hers but no longer attends any of her classes?

 

What he is has never been her student but is a student at her HS?

 

What if he's a student at a different HS?

 

 

Lewd acts in puclic apply in each case, but what about having an improper relationship with a student?

It's implied by the article stating he's a student. Which doesn't mean the article isn't wrong or badly written, of course...

But if you're married to the student, that's an affirmative defense.

Missing in the dialogue through the thread is that why would she have been so stupid as to have engaged in the act with him in such a public place? A little common sense and discretion would likely have kept the impropriety a secret. Not saying it makes her actions correct only saying that at the end of the day she is in trouble in part simply because she is stupid.
