  1. Shortly after an arrest a bail and release hearing will take place. Unless I''m wrong so far he hasn't been arrested?
  2. Don't jump to the conclusion that just because the police aren't immediately making arrets that they won't be forthcoming. This is a case where the police know who the people are involved with in this assassination. They are methodically moving forward making sure that they make no procedural mistakes that will come back to haunt them when it gets to the trial stage. What is impressive about this high profile case is that there haven't been any "leaks" coming from the police side of operation. That is unusual in this type of case. This is a tight and forward moving investigation. The authorities know that this is a highly publicized case and they know that AH has a lot of money to hire the best attorneys. Doing things right and slowly moving forward is better than quickly moving forward and making mistakes. So far I am impressed with the way they are handling their business. Odds are in this type of violent case where someone was killed with a shot to the head (assassination) the judge is not going to allow bail. This is similar to the OJ case where the killing was so brutal that the accused stayed in jail until after the trial was over.
  3. In the tough and gritty world of the street there is nothing unusual for peopple in the drug and criminal business not to bring their complaints to the police authorities. Why would this questionable character bring up the issue at this late date? The possible shooter is in a very weak position where he can't retaliate and where he is now under the scrutiny of another set of police authorities. If the prior shooting case goes to a criminal court setting you are correct that the post shooting espisode would not be allowed to be brought up in court. The rules are very strict in regards to relevancy in a criminal court. That isn't the case with the belated civil filing. In a civil court the trial and filing rules are much looser. In the civil setting a lot of tangential issues are permissable, even if not directly, associated with the particular case. Post incident behavior would not automatically be excluded from the civil trial because there is a relevancy of gun behavior that would be relevant to the civil case. Let it be understood I am not making any judgments on the legitimacy of the claims of the person involved in the early incident. I simply don't know.
  4. The below attachment is the Joe D interview with John Murphy that you referenced. Joe D is a very stubborn person who can be difficult to deal with when he believes he is right. But whatever faults he has he is a christian man who lives his beliefs. He has a heart of gold. There is nothing phony about him. His take on the Mario ring was typical Joe D with his very grounded view of life.   5. I'm very confident that in other years when the schedule was in our favor you didn't complain. Other than Ralph what other owner would hire the 70 yr old Nix as a GM? He was hired by the secluded owner simply because he knew him and didn't know the other prospective candidates. His three year record was 16-32. From a record standpoint the Levy/Jauron/Brandon era was more successful than the Buddy era. The Bills are now undergoing another rebuilding process i.e. undoing much of what he has done. If you think he was a good hire and did a good job then your standards are not very high.

My point is simple: The performance of this organization over the past generation has little to do with the schedule made by the league office. With respect to Ralph Wilson my position is well known to you. He is an incompetent buffoon who is most responsible for the status of this organization. Believe it or not, although it might not be reflected in the near term record, I am more confident than ever in the prospects of this franchise because the weird owner is no longer involved in the operation. I am also more confident in the future prospects of team not because Nix is the GM but because he is not the GM. Another perplexinging hire by the inscrutable owner.
  7. The parity schedule is a league designed system that benefits weakling teams like the Bills. It's intention is to mask the lack of competitveness of bad teams and give the illusion that they are still contending late into the seasnon when in reality they are not. Even in this "affirmative action" system the Bills have continued to fail miserably. To make an analogy it is like the Bills are given an outlandish amount of food stamps by the league and they still continue to go hungry. It is a tribute to the caliber of its ownership and organization. I give you credit for your detailed analysis of the scheduling system. But it is squandered effort. The reality is that the Bills are a losing/boring and irrelevant organizatiion in the NFL. You can reasonably make the claim that they are being discriminated against (this year) compared to the more relevant teams. My response is so what----what did you expect when your team has been an invisible franchise due to its own dysfunction for a generation? Don't worry about how teams such as the Pats, Cowboys, Giants, Steelers are compared to your ugly duckling franchise. Put your energy in building yourself up in instead of investing so much energy in making excuses why your plight is so unfair and difficult. In the grand scheme of things the schedule (fair or unfair) has little bearing on the status of the Bills. With respect to the Hernandez situation the league is acting responsibly in the way it is dealing with it. They are not making public statements and are monitoring the situation. Herandez is now not allowed on the team's premises. What more do you want them to do at this point? I know exactly what point you and many others are making. A lot of good energy and detailed work is put in your effort. From my perspective it is misplaced effort. If you want to focus on the scheduling issue then let's look at it from a wider perspective, rather than this singular upcoming season. The premise that the Bills are being screwed because of the way this year's schedule has worked out belies the reality that the Bills over a number of years are one of the most favored teams from a scheduling standpoint.
  8. Are you making the claim that the league acted outside its scheduling formula to specifically hinder the Bills? That is absurd. The scheduling software you referred to is only part of the equation in putting together a schedule. There are many variables associated with TV viewership and game appeal that are factored into the calculation for making up a schedule. Whether you want to accept it or not it is a reality that being a losing, boring and irrelevant team for a generation is without a doubt a consideration when putting together a schedule. If you don't think viewership is a factor in the equation then you are being very naive. On a yearly basis there are always teams that on balance have a favorable and unfavorable balance. That can't be avoided. There are many years where the weakling Bills have had a softer schedule than some of the powerhouse teams. It's not surprising that the scheduler complainers were silent? The Bills haven't even entered training camp and the excuses are being brought to the table. That is pathetic. What happens if the Bills surprise you and outperform your expectations, even with what you believe to be an unbalanced schedule. What will be your response then?
  9. You might think I'm angry but I'm not. My position is that if you review the Bills record over the past 15 yrs their paltry performance has little to do with the schedule. The Bills are a lower performing team that usually results in the schedule makers giving us a less rigorous schedule compared to high performing teams. You certainly won't hear the fans complaining that in prior years our schedule was too easy. There are a lot of factors that go into making a schedule. It is beyond any of our capabilities to understand all the variables involved in the calculation. So why be bothered with something you can't control? The season is not even close to starting. Yet the howls of scheduling injustice can already be heard. That is a sad commentary on a battered fan base.
  10. Maybe there is an imbalance in this year's schedule? So what! There are many variables involved in putting together a schedule. It's not easy to do. There is never a year when a team or teams feel that they are being shortchanged by the scheduler. If it appears that this year's schedule is skewed against the Bills that doesn't mean that in other years the schedule wasn't skewed in their favor. There are a lot of teams that on paper are contending with challenging schedules. Instead of stewing about something they can't control they go out and compete and win at a solid rate. The Bills have had losing seasons in nine out of the past ten years. The Bills have not made the playoffs in 13 consecutive year and still counting. The Bills are in involved in their third rebuilding project over the last decade. Our problems have little to do with the schedule. Stop looking outward for excuses. Instead of wasting crybaby tears over the schedule work your way out of your own self-created mess. You can't control what others do but you can control what you do. Excuses are for losers. I'm tired of the excuses. Although season hasn't even started yet the torrent of excuses are already coming into play. That is sad and pathetic. Do you know what a real loser looks like? It is a team that hasn't made the playoffs in 13 consecutive years and still counting. Do you want to know what a loser looks like? It is a team that has had losing seasons in nine out of the last ten years in a system designed for parity. Do you want to know what a loser looks like? It is a team going on its third rebuilding project in less than a decade. If you think whining and sniveling over a schedule is going to help its cause then you are badly mistaken. There comes a time where an organization has to hold itself accountable for its own poor record. That's how a mature organization acts; that's how a winning organization behaves.
  11. The Bills lose when they are rested and they lose when they are tired. The Bills lose at home and they lose on the road. The Bills lose when it is warm and they lose when it is cold. The Bills lose against good teams and they lose against bad teams. Whining over how the schedule lines up is a pathetic response from those fans who refuse to hold the franchse accountable for their own impotent performances. Act like a grownup and hold yourself accountable. Instead of pointing the finger outward for excuses look inward for solutions. This loser mentality is ugly to witness. It's embarrassing.
  12. Excuse making defeatists are manufacturing excuses as to why the Bills are at a disadvantage. The general claim is that this team is treated unfairly by he league by the way the games are scheduled. My point regarding Toronto games and not having home games late in this upcoming season is that the league has acted to accommodate this losing franchise, not acted to hinder it. As I previously stated upgrade the product on the field and the bogus side issues will vanish. This never ending quest for finding excuses as to why the Bills lose is embarrassng. Have some pride and stop with the incessant whining. Losers make excuses and winners win!
  13. You missed the point I was making regarding moving games to Toronto. I have no problem with it, and have not stated so. It is on balance a very good thing. My point in referencing the Toronto game is that since the league allowed us to move games out of town the organization lost whatever miniscule leverage and credibility it had with respect to scheduling. Let's not forget that the league accommodated the organizatiion when it allowed us to play in Toronto and the league accommodated the Bills prior numerous requests by playing fewer late season games this year. The major problem I have with the Toronto series is that it is over-priced for a garbage product. The best way to market the Bills, in Canada and western NY, is to upgrade the product on the field. In my view scheduling is an inconsequential issue and a lame manufactured excuse that has little to do with what ails this franchise. It's about the product----always has been and will be.
  14. The yearly scheduling complaint that this franchise makes to the league is that there are too many late season cold weather games that are difficult to sell out. This year the league accommodated the franchise. If the Bills fielded a competitive team the scheduling issue would be irrelevant, I doubt Roger Goodell and the league headquarters worry an iota about being watched by this ineffectual and losing franchise. With respect to scheduling this franchise lost their already very limited credibility when they moved home games out of their own town for the extra buck.
  15. I'm sure you used the time to get your batteries recharged and are ready to get back into the fray. I don't want to be too critical of monitors who volunteer their time doing their best to make sure things don't get out of hand. When I was assessed a personal foul I didn't even know exactly where and when I committed my infraction. I do appreciate the people who take the time to monitor the discussions. However, a short explanation and pointing out where the so-called indiscretion occurred would be useful.

  17. You are not the only person who inexplicably got assessed warning points. Join the club. At first I was upset, and wanted to get an explanation. When I inquired as to why I was given a warning I got no response. Don't worry about it. If you believe that it is an unfair assessment then don't let it bother you or take it personally. I very often disagree with your postings but I have never observed an attack response coming from you. Maybe the monitor felt that your regular WEO extended duels got a little out of hand. Maybe that is where the flag was improperly thrown? LOL
  18. The Bills have been bad for a generation. The scheduling has lilttle to do with its dismal record. Wasting time doing a detailed analysis on the variables of a schedule is pointless when compared to the influences of weird ownership and incompetent people making outlandishly bad football decisions. As I and others have already pointed out when an organization chooses to sell off a home game to another location it has no credibility in its complaints about the schedule. For those who are putting a lot of effort in proving that the schedule is unbalanced against the Bills my response is so what? Even when the schedule has been in our favor the Bills have consistently lost.. It is pathetic how so many people put so much effort in rationalizing why the Bills lose and why other teams more often win. I find the excuse mongering responses to be embarrassing.

There are years when the schedule comes out for most normal franchises (not the Bills) where an organization might believe the schedule is disadvantageous but ultimately do very well. Just because an opponent has additional days of rest doesn't predictably translate into success. What often appears to be an advantage doesn't always turn out to be an advantage. Teams making the long travel trip from the west coast to the east coast often win, even with the added challenge of having to contend with the time change. And the reverse is true. The biggest factor for the success of a team has little to do with outside influences. The major factors contributing to success have to do with the quality of the organizatiion and team. It's embarrassing to watch a large segment of the Bills fanbase make excuses for why they lose and make pathetic excuses for why other teams win. As pointed out by others this organization has been complaining to the league for years that the late season games are difficult to sell in Buffalo. So this year they schedule few late season games at the antiquated stadium, yet some people associated with the organization still howl. When a franchise on its own moves some games to another city it has no credibility on this scheduling issue. The schedule has nothing to do with the Bills being a loser for a generation. No outside influence has much to do with how poorly this franchise has performed. Whatever so called scheduling disadvantages this frachise is subjected to is the same scheduling disadvantages that other franchises are subjected to over time.
  20. Chad Johnson is out of jail now, prior to the end of her 30 day sentence. Obviously she wasn't steadfast in having him complete her disproportionate sentencing. Maybe the deluge of criticism she received from the legal community was a factor in her backtracking a bit????? The overwhelming view of the legal community (not the emotional and reactionary fanbase ) (not putting you in that category) believes that the judge exhibited poor judgment and behavior on that particular day. You might not accept that view but from what I have read and heard it is easy for me to make that assessment and be comfortablewith my position. If you think differently, then so be it. This case has struck a nerve with me because I felt after watching the video clip that an easy target, a very unlikeable and obnoxious person, was treated unfairly by a judge who has a lot of authority over the lives of people. Saying that she abused her authority might be too strong, but without a doubt she exhibited poor judgment; at least that is how I see it. Clearly you see it differently. Let's just chalk it up to respectful disagreement..
  21. The DA's office is not going to get involved in a public spat with a judge that they often appear before. The DA's office and CD's defense attorney worked out a plea deal that they and the judge were agreeable to. There are without a doubt many cases and circumstances where DAs believe that a sentence was disproportionate to the crime, especially when the defense is cooperating with the prosecution. We are just going to respectfully disagree on this point. My position is that this judge changed her initial ruling because of a particular act on a particular day. You believe otherwise. Let's leave it at that. I didn't say the entire legal community believed such and such. I did state that the near universal opinion of the legal community is that this judge exhibited poor courtroom presence and judgment. It certainly is my opinion (have repeated it in many ways) that this judge did diminish the reputation of the court with her intemperate behavior and poor judgment.

They are being smart in not speaking out. You certainly haven't heard from he DAs that she acted wisely. As I have stated in prior posts the universal point of view of those who are involved with the law and are knowledgeable about the court system believe that this judge performed very badly in this particular case. Fans can afford to make judgments based on emotions. Those associated with the legal system recognize that this judge acted in a manner that tarnished the system. You are creating a wider context that affected her intemperate reaction on that particular court date. Her injudicious response was to a particular court reaction to a specific CJ act that caused the courtroom to snicker. That was the basis for the changing of his sentence, not the prior behavior you alluded to. I'll repeat what I said in the prior post: CJ is out sooner than the judge's tantrum ruling not because the judge was right in her judgment but because the avalanche of criticism she received from those who are familiar with the legal system forced her to back off from that atrocious and out of proportion ruling she made on that particular day.
  23. Jay Skurski is a writer for the News who covers the Bills. You take one article he wrote and treat it as his body of work in analyzing the Bills. It isn't. Very often when writing pieces for other publications there are very strict limitations in the length of one's story. Thus a vapid and brief article. For nearly the past generation the Bills have been one of the easiest teams and organization to analyze. You don't need to be an incisive analyst to describe the state of the franchise that repeats itself most years. The focus usually is on its numerous weaknessess and very limited strenghts. Any analyst, including Skurski, who has stated over the prior decade that the Bills will struggle and be at the bottom of the heap has been correct in their assessment, not wrong. Very often fans don't want to hear what is painfully obvious to others who are not so invested with the hometown team. The NFL is still far away from the regular season. If a very preliminary and superficial report on the Bills bothers you now, how are you going to handle it when the reporting is on real game performances?
  24. There are plenty of ex-players, coaches and executives who are in the media business. Not one of them will say that the the current rebuilding Bills is going to be playoff or good team this year. If they did they would lose credibility and be laughed off the stage. The NFL analysts in the media who have been saying for more than a decade prior to each season that the Bills are not a good team have been unsurprisingly correct.Their job is to make fair-minded assessments, not cater to and play down to the fanciful fringe of the fanbase.

Explain the variance in opinion? You have repeatedly and erroneously portrayed CJ's behavior in the courtroom on that day as bad behavior. Watch the tape. He didn't act out of order and he didn't intend to act disrespectfully. Just because you don't like a person doesn't mean that that person should be treated unfairly in court. CJ is out of jail earlier than the judge's ruling not because the judge made a wise ruling but because it was apparent even to her after a deluge of criticism that she made a poor ruling.
