EO's can be useful, and within the President's authority (e.g. handling of secret info, which authority is explicitly granted to the President by legislation passed by Congress). But they were increasingly abused through the Bush and Obama administrations. And again: DACA isn't an EO. It's a department memo concerning prosecutorial discretion. The true stupidity of the 9th Circus decision is that it's establishing that prosecutorial discretion can't be used to counter prosecutorial discretion.

Just to pass. But I pass everybody, so I never leave it. Really, DC is just weird. There's so many left exits on expressways that people invariably and understandably drive in the left lane. Driving north on 270, once you get north of Frederick, MD, everyone starts driving in the right lane. -

It's as though, after Bush v. Gore, the entire state collectively said "Well...we're too stupid to vote, so we may as well be corrupt about it." -
I hadn't realized, when you asked, that the 9th Circuit had just upheld the original stay. Their logic is even funnier: they can't it this specific attempt, because the administration is arguing DACA is illegal when it's not. And they can't in any other attempt, because that would be arbitrary, capricious, and racist, and since you can only deport a small number of people a year the country must focus more resources on supporting people already here. Not an exact quote, but I'm not making that last up. The 9th Circus assumed a budgetary responsibility they don't possess, to support one Secretarial memo over another to rule that enforcement of the law is "arbitrary and capricious."

Referring to DACA? The court's decision seemed to be "Because it's not nice, and Orange Man Racist." Of course, if you're referring to DACA, it's important to note that the court decided an EO can't rescind a previous administration's department memo, and that prosecutorial discretion is forever binding.

"Reports" coming out now that the White House edited the video to make it look like Acosta accosted her when he actually didn't. Including frame-by-frame comparisons of CSpan and the White House release - that they apparently got from reddit or Alex Jones or someone. -
CNN should never allow his ass to go back in. Put him behind a desk in front of the camera, and make him the pundit he is. And the White House idiots shouldn't have reduced this to a single issue of "he touched a girl!" Given his history of disruptive, unprofessional behavior, they should have simply said "We're revoking his access, as he continually exhibits behavior that is disruptive and disrespectful to the rest of the White House press pool. We encourage CNN to assign as their representative an adult who will respect the rights of others in the press pool."

I just want to observe - but not in the Ginsburg thread - that most conservatives are wishing Ginsburg good health and a speedy recovery, despite political differences. Whereas, when Scalia died, a hell of a lot of liberals celebrated the death of the Devil. All you need to know right there about the differences in the country.

Not unheard of. If someone hacks your computer and puts child porn on it, you're guilty of distribution. Someone breaks into your home, trips on a rug, bashes his head, and dies, and you can be charged with criminally negligent homicide. I body-checked a guy in to a wall today after he tried to rob me at an ATM, pretty sure I'm guilty of assault.
