http://abcnews.go.com/US/wireStory?id=763400 Court Rules Woman Not Liable in Sex Suit BOSTON (AP) - A woman isn't legally responsible for injuries her boyfriend suffered while they were having consensual sex more than a decade ago, a state appeals court ruled Monday. The man, identified only as John Doe in court papers, filed suit against the woman in 1997, claiming she was negligent when she suddenly changed positions, landed awkwardly on him and fractured his penis. The man underwent emergency surgery in September 1994, "endured a painful and lengthy recovery" and has suffered from sexual dysfunction that hasn't responded to medication or counseling, the appeals court said. Although the woman may have exposed her boyfriend to "some risk of harm," the three-judge panel said her conduct during the sexual encounter wasn't "wanton or reckless" and can't support a lawsuit. The man's lawsuit already has been thrown out by judges in Salem District Court and Essex Superior Court. The appeals court upheld those rulings while noting that its ruling doesn't apply to cases where someone has negligently infected a partner with a sexually transmitted disease. "There are no comprehensive legal rules to regulate consensual sexual behavior," Justice Joseph Trainor wrote. "In the absence of a consensus of community values or customs defining normal consensual conduct, a jury or judge cannot be expected to resolve a claim that certain consensual sexual conduct is undertaken without reasonable care." The man's attorney, John Greenwood, said he is likely to appeal Monday's ruling to the state's highest court. "It's a case that hasn't been seen before in Massachusetts," he said. Greenwood argued that consensual sex doesn't mean "anything goes. ... The fact that some behavior was agreed to by the parties doesn't mean all behavior was agreed to by the parties." The woman's attorney didn't immediately return a telephone call Monday.

Robert Steinbuch, a counsel for Republican Senator Michael DeWine, filed the civil suit on Monday against Jessica Cutler, whose brief employment on DeWine's staff was terminated by revelations about her graphic journal of her sexual escapades. Writing under the nom de plume "Washingtonienne," Cutler last year briefly kept an X-rated on-line diary of her simultaneous relationships with up to six men around town, including an unidentified Bush administration appointee. Steinbuch was not identified in the diary but he claimed in the suit filed in US District Court here that Cutler's use of his initials, "R.S.," first name and other details made him "clearly identifiable." "Cutler's outrageous actions, setting before anyone in the world with access to the Internet intimate and private facts regarding (Steinbuch), constituted a gross invasion of his privacy," the suit said. "The widespread public dissemination of private facts have caused (Steinbuch) to suffer severe emotional distress, humiliation, embarrassment and anguish," the suit added, requesting unspecified damages. Since gaining notoriety as "Washingtonienne," Cutler signed a book deal for a reported 300,000 dollar advance and posed nude for Playboy magazine.

The incident allegedly occurred on Wednesday, but the Laura Solarin didn't learn about it until she called home to check on her son, Gabriel, after school and he told her what happened. "He gets the tape out of the desk and he starts wrapping it (around my head) in layers," said Gabriel, 11. "He went around (my head) maybe about 10 times. " Gabriel said the the teacher left the tape on him for about 15 minutes before two other teachers saw it. Laura Solarin told 7NEWS that she called Aurora police to report the incident. "It's inexcusable," she said. Police began an investigation and the school district suspended the teacher until they determine if the teacher acted inappropriately. The district launched its own investigation into the incident. No charges have been filed in the case and police weren't releasing the offense report because the investigation is still under way. They are investigating the case as possible child abuse.

http://www.reuters.com/newsArticle.jhtml?t...storyID=8477528 Yahoo sued over Candyman child porn site Fri May 13, 2005 02:25 AM ET SAN FRANCISCO (Reuters) - A minor and his parents have filed a $10 million lawsuit against Yahoo Inc. and a man who once operated a Yahoo Groups site where members traded child pornography.The lawsuit, filed on May 9 in U.S. District Court for the Eastern District of Texas, charged that Yahoo breached its duties by allowing co-defendant Mark Bates and others to share child pornography on a site, called Candyman, that Bates created and moderated via the Yahoo Groups service. Yahoo spokeswomen Mary Osako said the company had not been served and did not comment on pending litigation. Bates pleaded guilty in 2002 to setting up the Candyman group site for the trade and distribution of child pornography, the Houston Chronicle reported at the time. The site attracted thousands of users and was in operation for two months before Yahoo closed it down in February 2001. Pornographic photos of the plaintiff -- who is using the name Johnny Doe -- were taken and posted to the Candyman site by a neighbor, said the lawsuit, a copy of which was obtained by Reuters. Among other things, the plaintiffs alleged that Yahoo was aware of the activity on the site and that it took no action to block or remove the pornographic images of Doe and other children. Attorneys familiar with cases involving online service providers said the Communications Decency Act generally shielded Web sites from responsibility for material posted by users. "Unless the plaintiff has very concrete proof that Yahoo knew that this group contained child pornography, it's very likely that Yahoo will not be liable," said John Morris, staff counsel at the Center for Democracy and Technology in Washington. "We believe that they knew, and at a minimum didn't exercise reasonable care on their sites," said Adam Voyles, the plaintiffs' lead attorney. A child pornography investigation led by the FBI and dubbed Operation Candyman targeted Yahoo Groups users and resulted in the arrest of more than 100 people in the United States
