No, not at all. I'm just pointing out to Ed that he bought a gay car. He can't defend himself from the charge - since he did, in fact, by a gay car. So he does what he can instead: engages in feeble counter-attacks against my uber-geek-mobile, in a futile attempt to distract himself from the fact that he bought a gay car. -

So does Hudson v. Michigan. You're really arguing about to SCOTUS decisions that conflict with each other on their face, and picking the one you think is "right" over what you think is "wrong". Which is simply to say: you and I disagree on which SCOTUS decision we think is horseshit. No, it's not. As a point of criminal law, the manner in which a warrant is executed does not invalidate the validity of the warrant or evidence collected by it. It doesn't make legalized B&E by the police in the execution of a warrant right - were the police, in possession of a warrant, to break down my door right now and search the premises, I'd raise holy hell in civil court. But were they to find the evidence that the warrant was issued for...that evidence should be invalidated in court because they executed the warrant without knocking? -

Only when they make decisions he agrees with, which is the crux of the issue I have with his argument. The contested ruling now goes against the unanimous ruling 10 years ago...which means the court under Clinton was "right", while the one under Bush is "wrong". The common law argument he quotes is the only really convincing one...and even then, it's not immune to having holes poked into it...for example, Louisiana law is based not on English common law but on Napoleonic law...so does that mean the "politeness" aspect of a reasonable search, such as it is stated in English common law, doesn't apply in Louisiana? -

Actually...I'm not quite seeing the problem here. SCOTUS, according to everything you just posted, ruled on a point of procedure in executing warrants; which can basically be summed up as "be polite". There is no "politeness" requirement in the Fourth Amendment, it only protects against illegal search and seizure, and the legality of a search and seizure doesn't stem from the officers knocking and announcing themselves, but from two other little words notably absent from your post as well: "due process". And due process is satisfied, not by knocking and announcing the intent to execute the warrant, but by the issuance of the warrant in the first place. And yes, I know Wilson v. Arkansas says otherwise - but I thought Wilson v. Arkansas was a horseshit decision to begin with. -

I was thinking 1) It's really cool technology, which appeals to the uber-techno-geek in me, 2) It drives rather well, with surprisingly good handling and power (it's not a Vette, obviously...but for a hybrid it's pretty good. More than enough for regular driving.) 3) It's surprisingly roomy. My 6'4" frame fits very comfortably, and with the front seat down, I can carry 8 foot pieces of 5/4 mahogany easily. 4) It's a well-made Japanese car, not an American union-bulit "I get $40/hr to tighten a bolt, and I can't even manage that without !@#$ing it up" piece of sh--. 5) It cut my monthly gas bill from $180 to $60. And though I thought it was butt-ugly at first as well...it kind of grows on you. It at least isn't as hideous a styling as a Honda Insight or Scion. And while I'll admit it's not a masculine car...it's still not an overtly gay Honda Fagmobile like Ed bought... -

More importantly, US Steel is up about $4 right now. The difference being - and pay attention, finknottle, this is important here - people actually OWN US Steel (myself included - bought into it yesterday around $58 ). I'd invite Condi Rice over any of those other choices. Julia Roberts is apparently a major prima donna B word, from when I've heard her speak Jennifer Aniston's probably not the greatest conversationalist, and I may as well try to converse with a blender for all the brains Simpson has. Condi Rice, though, is one smart lady, irrespective of her politics, and would be a hellaciously interesting dinenr companion. Now, if the question were "With whom would you prefer to play 'Hide The Salami' in a vat of jell-o?"...Condi'd be last on the list.
