The Constitution's Preamble - which is in itself not a part of the law of the land states, "We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America."
"Rights" in this context appear to be "God-given" and not bestowed by Congress or any other government body.
The Right to Life is inalienable.
The Right to Liberty is inalienable.
And, the Right to pursue happiness is inalienable.
There's no "Right" to an Obamaphone.
