Von Miller faces arrest in domestic violence case in Dallas
Beck Water replied to ArdmoreRyno's topic in The Stadium Wall
Right, bright eyes. You're the prosecutor. The alleged victim is now saying it's all overblown, it's all a mistake, and no one was assaulted. How do you prove that the 911 call is the truth, and what she's saying now is cap? How do you prove that her injuries were, in fact, caused by Von Miller - who was not at the scene when police arrived? The girlfriend's pocket recorded audio. You bring your experts in voice analysis, Von Miller will bring his. Guess who can buy better experts? The point isn't that there was not evidence leading to a judge to decide there was probable cause to issue an arrest warrant. There was, as you note. The point is that in the absence of a victim who is willing to testify, or who now testifies that nothing happened and she was exaggerating on the 911 call (because she became frightened during a consensual BDSM-type scene, say) - what exactly are the facts? What is subject to proof? It's not so simple to sort from a legal basis. Quite possibly. Also quite possibly, she's enmeshed in the typical DV cycle and currently in the "remorse"/pursuit phase. -
Back in the days when Ty Dunne was writing for TBN, I loved his work. During his 4 years at Bleacher Report, I frequently enjoyed it. Then, I got to hand it to him for nerve and verve - he decided to go out on his own to support himself by pulling in paid subscribers to an independent long-story 'blog' format, right at the time when bloggers and subscription newsletters seemed to be dying in favor of social media content by advert-supported 'influencers'. But since then - I haven't admired a lot of content he put out. I don't feel that he holds himself to a high standard for verifying sources. He started out relying on disgruntled former Bills FO guys Jim Monos and Doug Whaley, who no one else in the NFL have wanted to hire. He needs to draw in subscribers to make a living, and the way to do that is to generate controversy. If you want to believe his shows, Isaiah McKenzie gets open all the time against zone and Josh Allen just inexplicably refused to throw him the football last season. I don't know who this "former assistant coach" Dunne quotes might be and whether he has an 'ax to grind' on the way out the door. I do know that in the 6 games prior to him being 'relieved of his duties', the Ken Dorsey offense spearheaded by the "gift from the Football Gods", Josh Allen, was averaging 20.6 ppg (a point BELOW league average 21.7 ppg) - this without any major injuries to key offensive personnel - and had given up 13 turnovers (more than 2 TO per game). In the same time period and despite all the turnovers, the injury-depleted defense, missing starters to season-ending IR at 2ndary, LB, and DL and down to the 3rd string at DB and LB on a game to game basis, has held opponents to 21.5 (slightly better than league average). So call me Cray-Cray, but from my seat in a comfy chair, I kind of feel like where we are is the result of the offense not living up to what a "gift from the Football Gods"-led offense should be able to generate. Do with this info what you will. PS I'm pretty sure Sean McDermott has an ego. I don't think anyone becomes a head football coach without having an ego. But for the successful coaches, that's typically tempered by a good leaven of humility and willingness to listen and hear. If McD is such an accountability-free egomaniac - well, it's harder to sustain winning year to year in this league than not. It was said that Daboll wasn't happy working with McDermott. Well, Daboll had a great first year with the Giants but the wheels have fallen off this season and Daboll has been seen screaming in Wink Martindale's face on the sidelines. Do with this info what you will, also.

There's the boilerplate "conduct detrimental to the team" clause. Look, here's the thing. One side of the story is exactly as you say. That's out in the media. [I am personally inclined to believe it because this isn't my first rodeo with seeing this pattern, but my personal beliefs aren't the issue here. No job actions should be based on personal beliefs] The other side of the story is, Miller wasn't there when the police arrived and the girlfriend allegedly now states it's all a big misunderstanding and no one was assaulted etc. So how does one prove that 1) assault occurred, rather than something consensual that maybe went a step far and frightened the woman (or some other exculpatory scenario 2) Miller was the assailant? There is evidence to collect and assemble that might paint a convincing picture supporting one or the other side. From the CBA/NFLPA point of view, that hasn't happened yet, and, as you point out, "anybody can make up anything". Being proven in a court of law to choke your pregnant girlfriend is cause for suspension by the league. But that isn't where we are right now, and from past League and legal timelines for this sort of thing, not likely to be there soon. -

I agree. Tell me which team rules, or social media policies, Von has violated? -

It goes further than this. The Bills would have to cut a *****-ton of players to free up enough cap to cut Von Miller. I apologize, I'm a little unclear on what you see as a "gaffe" by Beane? -

No, they're not saying "we are waiting a bit after he was charged". This has been explained multiple times up-thread Being arrested is NOT being formally charged. Arrest can follow formal charges filed by the prosecutor. Arrest can also take place on a warrant signed off by a judge (judges do not file charges) as having "probable cause", after which the alleged perpetrator can request bail and be released on bail, awaiting the prosecutor's review of the evidence and decision on charges. Don't take my word for it, Google. -
Bills Cap Breakdown by Greg Tompsett
Beck Water replied to DrDawkinstein's topic in The Stadium Wall
I dunno if the cap is a myth or the cap isn't a myth, but the Bills have said they want Hines to play for them next season. Hines has said he expects to play for the Bills next season. Hines didn't fight losing his salary of $2.5M and the Bills didn't try to recover his $500k signing bonus......Hines is getting basically, maximum PS money this season ($940k) I don't think it takes a dot-connecting genius to infer that Beane promised Hines he would be on the team next season in exchange for getting the cap relief with no negative PR/grievance filed this season. I think there's a bunch of other moves on Tompsett's list the Bills won't make, but the essential point is correct, there are moves to be made. -

With all respect, I really don't want to pull the thread into Araiza discussion Part 326 so I'm not going to respond about him again. -

Araiza was cut by the team. NFL players are "employed at will", the team can cut them at any time (and bear contractual consequences) Araiza was not disciplined or suspended by the team or the NFL. -

Crass to follow myself I know, but I'd like to point out that with the CBA, the NFLPA was trying to protect players against being placed in "limbo" by a team that has soured on them but for one or another reason doesn't want to cut them. The player under contract has the right to access the team facility, train there, receive medical treatment. eat team food. The team can cut them so they're not under contract. The team can make them inactive on game day. But contractually, I believe the team must "fish or cut bait", either let the player access the facility or cut them. Or, if there is good cause, suspend them - but there has to be cause. -

Don't think so I actually don't believe they can. People keep saying all sorts of things the Bills can do, but I'd be delighted to have a precedent or a reference to some portion of the CBA that allows this. The team can grant a player who requests it time off for "personal reasons" to deal with a family member's health or death. The thing is, the player has to request it. This has been dealt with and explained multiple times upthread. If you've read that and you're still unsure, you can try Quora: https://www.quora.com/Can-you-get-bail-for-a-crime-that-you-havent-been-formally-charged-with-yet Or as I suggested to Muppy upthread, you could google something like "can I be arrested and not charged with a crime? This seems to be a fairly clear explanation https://www.conyersnix.com/faq/difference-between-an-arrest-charge-and-conviction/ Trying to TL;DR: Arrest: Police detain you on suspicion of committing a criminal act. May or may not be proceeded by prosecutor filing charges; may not involve prosecutor at all Charges: Filed by prosecutor. Arrest may or may not follow; could just issue summons to appear in court to answer to charges In Von's case, he was arrested by police upon presenting probable cause to judge. Prosecutor has not filed charges (yet). If you are arrested, you have the right to "pray for bail" (which is not a religious move, but an application to the judge) whether or not you've been charged. This is an important protection Americans have against the habit in some countries of arresting and incarcerating people for indefinite periods of time without charges. -

I'd like to think I know more than the average Joe Fan about contracts and cap issues and parts of the CBA. I have no idea if there is an avenue for a team "suspending" a player (with or without pay) or placing him on "administrative leave" and locking him out of the building. I actually think there isn't. -They can make him inactive. -They can cut him (and immediately eat $32M extra dead cap this season) -IF he has broken a team rule or they can argue he has been guilty of "conduct detrimental to the team" or "conduct detrimental to the league", maybe they suspend him - but the player can appeal, and then we loop back to the original point, which is - an investigation has not completed, Von Miller has not been charged, and there is no clearcut conclusion here. Do I personally believe that it's "more likely than not" that Von Miller physically and verbally assaulted his pregnant girlfriend and that what he did is a "Red Flag Warning" for DV murder? Yes, that's what I personally believe. But I don't think someone should be found to have committed "conduct detrimental" based upon my personal belief, either. -

Beck Water replied to ArdmoreRyno's topic in The Stadium Wall
I'd like to throw out a thought. -What Von Miller is alleged to have done is despicable, and if it's beyond a reasonable doubt he did it, he should not be in the building -At this point, it's not beyond a reasonable doubt. It's not even clear that the evidence is enough to charge him with a crime -If he's charged with a crime, for sure, he should not be on the field until the investigation completes. The NFL has a procedure for this, "Commissioner's Exempt List" -If he's not, just maybe...the NFL's procedure of waiting to take action until an investigation takes place...is the 'benefit of doubt' standard we would all like to have applied to us? Crazy Talk, I know. I'm not sure the "team can suspend him". On what basis at this point? They can make him inactive, and let him sit on the sideline in civvies, I guess. -

Said it upthread. Jags came in with the notion that they only needed to defend against the pass 3 yards past the LOS, and the 1Q reinforced that notion. But the Bengals are smelling blood, it’s gonna be tough to flip the script
