McDermott/Beane press conference 8/27: Matt Araiza released
Motorin' replied to YoloinOhio's topic in The Stadium Wall
I don't think her attorney has contradicted himself, outside of people misinterpreting aspects of this posts. -
How do you give a guy a second chance at redemption over something he is denying that you don't know the truth about?

I agree with your take on the way Beane and McD handled it. I think a lot of the intense reaction Bills fans have expressed over the last few days has more to do with the opinion expressed by a contingent on the board, after the civil case was filed, that the Bills have to stand by their player unless and until proven guilty. And the initial Bills message that they had thoroughly examined the situation and have no further comment exasperated the concern that the Bills had decided to stand by their player. That worry began to change when he didn't take the field and didn't practice with the team. There's been a number of terrible takes, from assuming he's guilt of everything to blaming the young woman. There's always going to be bad takes on the boar... See the Josh Allen Draft thread as prime example. I'm seeing a lot of guys whose initial reaction was, the Bills need to stand up for him until proven guilty, being the ones that are mad at the people who are upset the Bills waited as long as they did to address it. Yet for the most part, most everyone despite their initial take has arrived at the same conclusion. That he can't be on the team at this point... September 8th cannot get here soon enough... At the same time, the Bills players had better prepare for the inevitable questions that are going to come from the national media.

Matt Araiza accused of rape, served with a lawsuit.

Yeah, these are the fine details of the case that we can only speculate about. -

Yeah, it seems as though she got the names from the police when they setup the pretext calls. -

Araiza's attorney disputes many aspects. He claims she was not intoxicated when she arrived and that Matt never gave her a drink. What he has not disputed was that Matt had sex with her outside of the house shortly after meeting her, and that she was later sexually assaulted by other members of the team. In fact, Araiza's attorney stated that one of the other teammates may be charged with rape based on the evidence he has obtained. -

Yeah, I've seen plenty of national media hold the Bills up as examples of a class organization in stark contrast to the Browns. Anyone that wants to continue to equate a team that cut a player within 48 hours of a law suit being filed, and a team that guaranteed 250 million after multiple law suits were field just doesn't know what they're taking about. -

As soon as the Civil Suit begins, they can subpoena the evidence obtained in the criminal investigation. They are after the results of the rape kit test, which may or may not have even been processed yet. -

Yeah, the one big mistake the Bills made was saying they had conducted a thorough examination prior to naming him starter when in reality they could not possibly have obtained all of the facts. Beane was upfront that that was a poor response and that they should have said they are in the process of conducting an examination. It's over now. They made mistakes, admitted them and did the right thing as soon as they could. The whole situation is sad, but it's not something that should hang over their heads for the remainder of the season. And I don't think it will. -

Skurski should get over blaming Beane for not immediately releasing Araiza. The only reason the Bills were in the position they were in is bc Araiza did not disclose that he was under investigation for rape. The Bills had no way of knowing there was an open investigation. The fact that Araiza never told his agent, the NFL or the Bills is the cause of the short term black cloud over the organization. -

That's a really bad assumption given how long these types of cases take. The case was only turned over to the DA two or three weeks ago. The fact that they have not brought charges in that time does not at all mean that they have refused to bring charges. They are still evaluating... -

The DA doesn't have a timeline as to when they have to file charges. They have not decided yet. The woman's attorney said they filed the civil suit for several reasons. The first is bc they don't have any of the evidence from the criminal investigation, and can't get any of it without the subpoena power that comes with the civil suit. The second is to bring public attention on the case, since they feel like it's being ignored. With the amount of public scrutiny the DA won't be able to sweep it under the rug if there's evidence to prosecute. And the third reason they stated was that she in particular did not want to see Matt play in the NFL and make a ton of money while she believes he did what she is alleging. So it's the opposite of a money grab, from what they said. And the fact that he got cut bc of the public attention they created and lost out on his playing salary would seem to back that up. -

I'm not saying they do have hard video evidence. If they do and they haven't charged anyone I'd say that's a real problem. I'm just commenting on the amount of data... Maybe they just copied all of the hard drives of 5 guys computers. That would make sense. -

That's a lot of terebytes if they are video and photos. Like a years worth of work of a professional videographer. -

No, the SDPD concluded their nine month investigation on Aug 5th and turned all of their evidence over to the DA to determine what if any charged will be filed. The investigation includes TB's of data from search warrants they executed, recorded pretext calls with Araiza and who knows what else. Matt failing to tell the NFL, his agent and the Bills that he was under investigation by the police for allegations of rape during the draft process is the only reason the Bills organization is in the difficult situation they are in. -

I'm guessing there's at least a possibility that the Bills thought it would be settled. Once the law suit and as filed and all of the details emerged, they took a prudent 48 hours to determine the best course of action. Nothing about this is great. But they got to the best possible solution given the set of circumstances. -

Beane said they were wrong to say that had conducted a thorough examination. That they should have said it was an ongoing examination. -

It's in dispute whether it was his residence or not. His lawyer says it wasn't. But I'm not sure how much I trust "you better believe it" Kerry Armstrong. -

She said it's not about her getting money. But about her getting justice, and she doesn't want to see him make a ton of money. She came forward publicly on June 3rd to the media in San Diego. If it was a money grab, they would have waited as long as possible so that he'd have more money to go after. -

Actually, he got his client what she wanted. She said last month she's not in it for the money and that she doesn't want MA to make money in the NFL. It was Araiza's attorney that reached out and offered for a cash settlement first. Her attorney said no settlement. It was Araiza's attorney that warned not to force the Bills hand to cut him bc they're be no money to get. They want public, said it wasn't about money. Now he's cut and won't get his salary. The claim that it's a cash grab holds little water. -

She was quoted in an article a month ago that she's going public now bc she doesn't want him to play in the NFL and make a ton of money. Which seems to completely contradict the cash grab claim. -

I got the opposite. Beane wouldn't answer when asked if MA with held info, but inadvertently confirmed that he had. Beane said they didn't know anything during the draft, and that Araiza's agent knew nothing. But Araiza had been investigated by the police prior to the draft, and allegations were made against him on campus at SD State. So Araiza failed to disclose during the pre-draft process to the Bills or his agent. -

Another major detail came out. Beane said they knew nothing, and Araiza's agent knew nothing leading up to the draft. And that had they known of these allegations he would have been off their draft board. What looks even worse for Araiza is that the police were investigating long before the civil suit and before the draft, and he didn't disclose to the NFL or his agent. -
