  1. I would be shocked if they ever pursued something that didn't involve 1. raw footage or 2. trademark infringement. All it takes is one precedent and every would-be NFL reporter would have blueprint for how to avoid IP infringement.
  2. That's exactly what cover1 is doing. They're taking clips from all 22s and offering commentary/criticism on specifics, usually a specific topic/player/position group. They're not using unlimited footage of whole games while doing their own commentary. They are addressing specific things in an educational/analytical way.
  3. Seems like NFL is sore that they avoided using team trademarks and the like so they can't just shut down the site. So instead they try and deny them access, not that I have a problem with that necessarily.
  4. If they are then using that all 22 footage for original educational or discussion use it would qualify as fair use.
  5. I have a feeling a lot of what can get a site shutdown is their use tm/ip in the advertising. Are they displaying NFL logo? team logo? When I look at cover1 i don't see any of that sort of stuff. It looks like they go out of their way to not show it. They also seem to alter all the images they put up on the site as well.
  6. I wouldn't say its nonsense. We're not talking about charging people to watch old games or anything. People have the right to fair use and that extends to educational/teaching efforts as well as general discussion. I don't see anything on cover1.net that couldn't be said to fall into those categories. Perhaps the reason the NFL has been very selective in their enforcement is they are afraid they will lose in many cases.

  9. I'm not sure people are making excuses for him anymore. Think his star has faded. Used to be he was the consensus pick as the future best QB in the NFL after a few retirements. Now he would barely get mentioned and probably just from nostalgia.
  10. I find the statement "I did all of this well before a failed test was even confirmed" to be a major red flag. I don't think his appeal goes well.

  15. I was optimistic at first, but I think we would have heard more positive things about him if he really had much of a chance. Same goes for the rugby running back. Maybe we'll get to keep them on the practice squad.

  17. The details of clawback aggreeements are essential to any negotiation in which they are attached. It was his job to mind, regardless of his feelings on where the franchise plays. If one party has an unusual or excessive demand/request its your job as a negotiator to get something for it.
  18. Just what do you think is being negotiated? The state wants the team to stay forever and ever. The team wants the state to help provide facilities. Why should a negotiator not care about an unusually large clawback that hadn't been previously discussed? and even if he doesn't care why should he let that on.
  19. I mean it is a negotiation. What do you expect a negotiator to do? Vigorously agree?
  20. Seems a little silly to give politicians the credit. It was obvious as the time that state officials wanted the Bills to stay in Buffalo and merely by pursuing the renovation when he did Ralph was trying to keep the Bills in Buffalo. It's Littman's job to focus on the financials, at the end of the day Ralph agreed to significantly reduce the the demand of his asset and presumably the value as well. He didn't have to do it, but he did. The politicians didn't loose anything by the deal Ralph Wilson did. He gets the "credit". Is Ralph's negotiator suppose to do the other sides job for them?
