The Constitution empowers the President to enter into treaties upon the approval of the Senate. HOWEVER, once the treaty is entered into, it becomes enforceable law. The judiciary is empowered to interpret the law. There is also international common law (for lack of better words). There are many, many cases and a long tradition of Supreme Court cases concerning the "Law of Nations." Whether it be shipping, maritime, trade, etc.

thank god we have a judiciary that is willing to stand up to, or as delay put it "thumb its nose at" the congress and the president. Maybe delay should take a gander at the COnstitution.
