It should be prosecuted where crimes have been committed. Where crimes have not been committed, it should be exposed as what it is. Free speech and freedom of the press, as concepts, are far too important as part of the process of human liberty to scrap simply because some people choose to do things I don't like with those freedoms. Process is more important than individual outcome, because the process protects all of us, and once the process is gone, none of us are free.

I'm not sure what the solution is, but the government should not be able to batter private citizens into submission through the costs of defending themselves against a prosecutor with an agenda and a bottomless pit of resources funded by the tax payer.
