    "the prosecutor has to prove, beyond a reasonable doubt, that the defendant did not reasonably and actually mistaken the alleged victim’s age." If she testifies that he never asked her age, the prosecutor can claim that there was no way he could "reasonably and actually have mistaken her age"

    When will he state this? In his opening remarks? How will he convince the jury this is true if his client doesn't testify? If he does testify he will have to swear that he was lying on that phone call.

    How does such a defense get entered if he doesn't even claim it? She was clearly underage. He can claim he reasonably thought she was of age without stating so in court?
