Actually you can fire a gun from the shoulder of the road, as long as the bullet does not pass over the road and you are 5 hundred feet from the nearest dwelling, unless you have the owners permission. However you are correct, it is illegal for an individual to shoot a wounded animal. A law officer is supposed to do it, but I know a guy who was asked by an officer to shoot a deer that was hit by a car because he didn't want to fill out the paper work.
