No, what I'm saying is Matt didn't gang rape her and he will likely not face any charges. It's been confirmed it's the house. So it's the same party. It is enough to discredit her accusations against Araiza. As many contradictions her attorney has made, this could even be the video they reference in the civil complaint. Her attorney has gone from rage tweeting to silence the last two days. -

Well I didn't say that, but I will say I think it helps Araiza clear his name. Based on the publicly available information, I think he and her had consensual sex, and later she was raped by some people at the party. I don't think Araiza gave her a drink nor ever went inside the house. I don't think Araiza will be charged with anything. I understand it was statutory, but in California if you were misled about the person's age, that is a qualifiable defense. Again her attorney has lied about a lot of facts, and the only legal document on all of this is the one he narrated and filed. It also lists 20 other John Roes in it facing the same allegations as Araiza. -

There is a video making the rounds on the internet allegedly of the victim at the party. Video was posted 3 days after the incident, matches the location of the party, timing, and clothing based on photos ABC, CBS, etc have shared. There is more public information that clears him at this point than anything else, plus her attorney has lied about several facts. I believe all rapists are evil and deserve maximum punishment. However, I am not sure Araiza is guilty of what he's being accused of. Here's the link to it on YouTube: -

If you cared about the victim, you'd care more about her attorney ruining her case by his contradictions. I understand it's your opinion he has not, but his track record shows a similar pattern. Either way, it's Sunday, and I'm going to enjoy my day, I wish the same to you. I'm going off of California law, the clerk reviews the complaint to make sure it's proper before assigning a case number to it. Dan cannot issue subpoenas until that happens. Even then, he does have to file a copy of EVERY subpoena with the court within 48 hours. -

I'm going off of California law. The reason no case number has been assigned is because it has not been reviewed. It was filed Thursday and nothing was assigned instantaneously. The court could throw it out at any point as well. -

Again, not until the complaint has been reviewed and assigned a case number. At this point all he has done is file a complaint. If I'm missing the case number somewhere, again, please let me know. But I'm not wrong. And he will have to file a copy of every subpoena to the court. -

In California, it does have to reviewed and stamped before the plaintiff can issue subpoenas. I didn't see a case number stamped on the complaint documents, so again, if I'm missing that somewhere please let me know. It is most common in CA for a third party to issue the subpoena, however not required in all cases. In any case, the plaintiff will have to submit a copy of every subpoena form to the court within a certain time frame, I believe it is 48 hours, can't remember. -

Please elaborate on what part you think is wrong. Right now Jane Doe's attorney cannot issue subpoenas based on California law because he's only filed a civil complaint. A court does have to review the civil complaint and make a decision first before he's able to issue subpoenas. There's no stamp on the filing complaint based on what I've seen, so if there is, let me know. -

I disagree, respectfully. My concern in this is the victim and her getting the resolution she deserves. His pattern of contradictions and not being an A level attorney in this field will potentially just snowball until he gets exposed -- ruining her chances at getting the resolution she deserves. So it's my personal opinion that if anyone truly cares about her, they would be concerned with these things, all of the things. -

I mean these are serious allegations so the fact that her attorney is being grossly misleading and lying at best, along with changing the narrative a few times deserves more scrutiny. Reporters should be asking all the questions. That's what I would call good journalism. He's also eliminated all of her chances to recover any monetary damages, which is the whole point of him filing the complaint to try to sue. Like I really feel bad for this girl. Like really. -

It's been asked repeatedly from a ton of fans why her attorney is lying about not making an initial settlement offer attempt. It's also been repeatedly asked why her attorney is lying that he can issue subpoenas now when in fact he cannot. He can't until the court reviews his filed complaint and makes a decision. Even then, if he gets that, a court clerk will still have to review and approve every subpoena he wants to serve. -

Gloria Allred should be repping Jane Doe, not this hot-headed male attorney. Gloria's record is nearly perfect and she's based in SoCal, Jane Doe's attorney has already admitted he's at least 0-2 against Araiza's attorney in cases, that's not good for the victim. You have to wonder why Gloria isn't taking on this case. Jane Doe's attorney also has martyr syndrome, he's alienated every possible bridge for a settlement and he's gone nuclear. He's lied about making a settlement offer and being able to issue subpoena's (he can't until the court reviews the complaint and makes a decision). He's not going to stop attacking the Bills, fans should prepare for a media spectacle from him, possibly even at the Rams game considering San Diego is just over an hour from LA. Hate to say it but that's the only pattern he's shown to this point. That all being said, good on the Bills for making a quick decision. If Bills fans are donating to a women's survivor fund or organization of any type, please let me know. -

If your strategy is to put media pressure on Araiza, you can't contradict yourself and you don't take your foot off the gas. If he doesn't do any media interviews today, he's doing her and her story a great disservice. Hopefully some national expert lawyers in these types of cases are paying attention and reaching out to her. -

At this point, if I was the accuser, I would be seeking new representation. Her attorney is making statements and immediately contradicting them. Any victim or potential victim of a sexual crime deserves better. -

I think at this point it's unlikely Howard is traded. The Athletic writer jumped the gun on that. -
